| 6 | 6 | | proposing a constitutional amendment to abolish the office of |

| 7 | 7 | | county treasurer of Somervell County. |

| 8 | 8 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 44, Article XVI, Texas Constitution, is |
|---|
| 10 | 10 | | amended by adding Subsection (e) to read as follows: |
|---|
| 11 | 11 | | (e) The office of County Treasurer in Somervell County is |
|---|
| 12 | 12 | | abolished. The Commissioners Court of Somervell County may employ |
|---|
| 13 | 13 | | or contract with a qualified person or may designate another county |
|---|
| 14 | 14 | | officer to perform any of the functions that would have been |
|---|
| 15 | 15 | | performed by the County Treasurer if the office had not been |
|---|
| 16 | 16 | | abolished. |

| 17 | 17 | | SECTION 2. The following temporary provision is added to |
|---|
| 18 | 18 | | the Texas Constitution: |
|---|
| 19 | 19 | | TEMPORARY PROVISION. (a) The constitutional amendment |
|---|
| 20 | 20 | | proposed by the 88th Legislature, Regular Session, 2023, abolishing |
|---|
| 21 | 21 | | the office of County Treasurer in Somervell County takes effect |
|---|
| 22 | 22 | | only if, at the statewide election at which the amendment is |
|---|
| 23 | 23 | | submitted to and approved by the voters, a majority of the voters of |
|---|
| 24 | 24 | | Somervell County voting on the question at that election also favor |
|---|
| 25 | 25 | | the amendment. The amendment takes effect January 1, 2024, if the |
|---|
| 26 | 26 | | conditions of this subsection are met. |
|---|
| 27 | 27 | | (b) This temporary provision expires January 2, 2024. |
|---|
| 28 | 28 | | SECTION 3. This proposed constitutional amendment shall be |
|---|
| 29 | 29 | | submitted to the voters at an election to be held on November 7, |
|---|
| 30 | 30 | | 2023. The ballot shall be printed to permit voting for or against |
|---|
| 31 | 31 | | the proposition: "The constitutional amendment providing for the |
|---|
| 32 | 32 | | abolition of the office of county treasurer in Somervell County." |
