| 6 | 6 | | proposing a constitutional amendment creating the Texas water fund |

| 7 | 7 | | to assist in financing water projects in this state. |

| 8 | 8 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Article III, Texas Constitution, is amended by |
|---|
| 10 | 10 | | adding Section 49-d-16 to read as follows: |
|---|
| 11 | 11 | | Sec. 49-d-16. (a) The Texas water fund is created as a |
|---|
| 12 | 12 | | special fund in the state treasury outside the general revenue |
|---|
| 13 | 13 | | fund. The fund is administered by the Texas Water Development Board |
|---|
| 14 | 14 | | or by that board's successor in function as provided by general law. |
|---|
| 15 | 15 | | (b) The administrator of the Texas water fund may use the |
|---|
| 16 | 16 | | fund only to disburse money to other funds administered by the Texas |
|---|
| 17 | 17 | | Water Development Board or that board's successor in function. The |
|---|
| 18 | 18 | | administrator may restore to the fund money disbursed from the fund |
|---|
| 19 | 19 | | and deposited to the credit of another fund. Legislative |
|---|
| 20 | 20 | | appropriation is not required for the administrator to restore |
|---|
| 21 | 21 | | money to the fund. |
|---|
| 22 | 22 | | (c) The Texas water fund consists of: |
|---|
| 23 | 23 | | (1) money transferred or deposited to the credit of |
|---|
| 24 | 24 | | the fund by general law, including money from any source |
|---|
| 25 | 25 | | transferred or deposited to the credit of the fund authorized by |
|---|
| 26 | 26 | | general law; |
|---|
| 27 | 27 | | (2) any other revenue that the legislature by statute |
|---|
| 28 | 28 | | dedicates for deposit to the credit of the fund; |
|---|
| 29 | 29 | | (3) investment earnings and interest earned on amounts |
|---|
| 30 | 30 | | credited to the fund; |
|---|
| 31 | 31 | | (4) money from gifts, grants, or donations to the |
|---|
| 32 | 32 | | fund; and |
|---|
| 33 | 33 | | (5) the redeposit of money disbursed from the fund. |
|---|
| 34 | 34 | | (d) The legislature by general law shall provide for the |
|---|
| 35 | 35 | | manner in which money from the Texas water fund may be used, subject |
|---|
| 36 | 36 | | to the limitations provided by this section. |
|---|
| 37 | 37 | | (e) The legislature by general law may provide for costs of |
|---|
| 38 | 38 | | investment of the Texas water fund to be paid from that fund. |
|---|
| 39 | 39 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 40 | 40 | | submitted to the voters at an election to be held November 7, 2023. |
|---|
| 41 | 41 | | The ballot shall be printed to permit voting for or against the |
|---|
| 42 | 42 | | proposition: "The constitutional amendment creating the Texas |
|---|
| 43 | 43 | | water fund to assist in financing water projects in this state." |
