68 A JOINT RESOLUTION
79 proposing a constitutional amendment providing for the creation of
810 the Texas land and water conservation fund to assist in preserving
911 critical natural resources in this state.
1012 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1113 SECTION 1. Article III, Texas Constitution, is amended by
1214 adding Section 49-d-17 to read as follows:
1315 Sec. 49-d-17. (a) The Texas land and water conservation
1416 fund is created as a special fund outside the state treasury.
1517 (b) As provided by general law, money in the Texas land and
1618 water conservation fund may be administered and used, without
1719 further appropriation, by the Texas land and water conservation
1820 board or that board's successor in function to provide funding for
1921 conservation and restoration of and public access to land, water,
2022 and natural resources.
2123 (c) Separate accounts may be established in the Texas land
2224 and water conservation fund as necessary to administer the fund or
2325 authorized projects.
2426 SECTION 2. This proposed constitutional amendment shall be
2527 submitted to the voters at an election to be held November 7, 2023.
2628 The ballot shall be printed to permit voting for or against the
2729 proposition: "The constitutional amendment providing for the
2830 creation of the Texas land and water conservation fund to assist in
2931 the voluntary protection of Texas' water quality, wildlife habitat,
3032 natural areas, and parks, while not increasing the rate of any
3133 taxes." If that amendment is not approved by the voters, this Act
3234 has no effect.
