55 A JOINT RESOLUTION
66 proposing a constitutional amendment authorizing the legislature
77 to exempt from ad valorem taxation the total assessed value of the
88 residence homestead of an unpaid caregiver of an individual who is
99 eligible to receive long-term services and supports under the
1010 Medicaid program while the individual is on a waiting list for the
1111 services and supports.
1212 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Article VIII, Texas Constitution, is amended by
1414 adding Section 1-q to read as follows:
1515 Sec. 1-q. The legislature by general law may exempt from ad
1616 valorem taxation the total assessed value of the residence
1717 homestead of an unpaid caregiver of an individual who is eligible to
1818 receive certain long-term services and supports through a program
1919 established under federal law that provides health care and related
2020 services and benefits to persons with disabilities and under which
2121 this state receives federal matching money during the period the
2222 individual is on a waiting list for the services and supports. The
2323 legislature by general law may provide additional eligibility
2424 requirements for the exemption.
2525 SECTION 2. This proposed constitutional amendment shall be
2626 submitted to the voters at an election to be held November 7, 2023.
2727 The ballot shall be printed to permit voting for or against the
2828 proposition: "The constitutional amendment authorizing the
2929 legislature to exempt from ad valorem taxation the total assessed
3030 value of the residence homestead of an unpaid caregiver of an
3131 individual who is eligible to receive long-term services and
3232 supports under the Medicaid program while the individual is on a
3333 waiting list for the services and supports."
