| 5 | 5 | | proposing a constitutional amendment recognizing the right of a |

| 6 | 6 | | person to purchase, to own, and to operate a motor vehicle that is |

| 7 | 7 | | powered by an internal-combustion engine. |
|---|
| 8 | 8 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Article I, Texas Constitution, is amended by |
|---|
| 10 | 10 | | adding Section 36 to read as follows: |
|---|
| 11 | 11 | | Sec. 36. (a) A person has the right to purchase, to own, and |
|---|
| 12 | 12 | | to operate a motor vehicle that is powered by an |
|---|
| 13 | 13 | | internal-combustion engine, subject to: |
|---|
| 14 | 14 | | (1) laws or regulations relating to: |
|---|
| 15 | 15 | | (A) who is authorized to operate a vehicle, a |
|---|
| 16 | 16 | | type of vehicle, or a class of vehicles; or |
|---|
| 17 | 17 | | (B) the mental or physical competency required to |
|---|
| 18 | 18 | | operate a vehicle; |
|---|
| 19 | 19 | | (2) laws or regulations that impose or are subject to a |
|---|
| 20 | 20 | | criminal penalty; and |
|---|
| 21 | 21 | | (3) restrictions on the use of a vehicle resulting |
|---|
| 22 | 22 | | from the commission of a criminal offense or other violation of a |
|---|
| 23 | 23 | | law or regulation. |
|---|
| 24 | 24 | | (b) A law or regulation may not be enacted or adopted for the |
|---|
| 25 | 25 | | purpose of abridging the right granted by this section. A law or |
|---|
| 26 | 26 | | regulation enacted or adopted in violation of this subsection is |
|---|
| 27 | 27 | | void and unenforceable. |
|---|
| 28 | 28 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 29 | 29 | | submitted to the voters at an election to be held November 7, 2023. |
|---|
| 30 | 30 | | The ballot shall be printed to permit voting for or against the |
|---|
| 31 | 31 | | proposition: "The constitutional amendment recognizing the right |
|---|
| 32 | 32 | | of a person to purchase, to own, and to operate a motor vehicle that |
|---|
| 33 | 33 | | is powered by an internal-combustion engine." |
