| 9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1, Article VII, Texas Constitution, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 1. (a) A general diffusion of knowledge being |
|---|
| 13 | 13 | | essential to the preservation of the liberties and rights of the |
|---|
| 14 | 14 | | people, it shall be the duty of the Legislature of the State to |
|---|
| 15 | 15 | | establish, ensure public oversight of, and make suitable provision |
|---|
| 16 | 16 | | for the support and maintenance of an efficient system of public |
|---|
| 17 | 17 | | free schools. |
|---|
| 18 | 18 | | (b) Each child of school age who resides in this state is |
|---|
| 19 | 19 | | entitled to access, with the consent of the child's parent, a public |
|---|
| 20 | 20 | | free school. |
|---|
| 21 | 21 | | (c) The state may not: |
|---|
| 22 | 22 | | (1) abridge the right of a parent to place the parent's |
|---|
| 23 | 23 | | child in an educational setting of the parent's choice outside of |
|---|
| 24 | 24 | | the public free schools; or |
|---|
| 25 | 25 | | (2) regulate the provision of education in an |
|---|
| 26 | 26 | | educational setting for which the state does not provide support or |
|---|
| 27 | 27 | | maintenance. |
|---|
| 28 | 28 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 29 | 29 | | submitted to the voters at an election to be held November 7, 2023. |
|---|
| 30 | 30 | | The ballot shall be printed to permit voting for or against the |
|---|
| 31 | 31 | | proposition: "The constitutional amendment regarding public free |
|---|
| 32 | 32 | | schools and prohibiting certain state regulation regarding private |
|---|
| 33 | 33 | | educational settings." |
