99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1, Article VII, Texas Constitution, is
1111 amended to read as follows:
1212 Sec. 1. (a) A general diffusion of knowledge being
1313 essential to the preservation of the liberties and rights of the
1414 people, it shall be the duty of the Legislature of the State to
1515 establish, ensure public oversight of, and make suitable provision
1616 for the support and maintenance of an efficient system of public
1717 free schools.
1818 (b) Each child of school age who resides in this state is
1919 entitled to access, with the consent of the child's parent, a public
2020 free school.
2121 (c) The state may not:
2222 (1) abridge the right of a parent to place the parent's
2323 child in an educational setting of the parent's choice outside of
2424 the public free schools; or
2525 (2) regulate the provision of education in an
2626 educational setting for which the state does not provide support or
2727 maintenance.
2828 SECTION 2. This proposed constitutional amendment shall be
2929 submitted to the voters at an election to be held November 7, 2023.
3030 The ballot shall be printed to permit voting for or against the
3131 proposition: "The constitutional amendment regarding public free
3232 schools and prohibiting certain state regulation regarding private
3333 educational settings."
