| 9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Article VII, Texas Constitution, is amended by |
|---|
| 11 | 11 | | adding Section 3A to read as follows: |
|---|
| 12 | 12 | | Sec. 3A. THE BASIC ALLOTMENT. For the Fiscal Year of 2025, |
|---|
| 13 | 13 | | a school district is entitled to a basic allotment equal to $7,500 |
|---|
| 14 | 14 | | for each student in addition to any higher amount per student as |
|---|
| 15 | 15 | | provided by the Legislature. For all subsequent state fiscal |
|---|
| 16 | 16 | | years, the Legislature shall set the basic allotment under the |
|---|
| 17 | 17 | | Foundation School Program at the amount that results from applying |
|---|
| 18 | 18 | | the inflation rate, as determined by the comptroller on the basis of |
|---|
| 19 | 19 | | changes in the Consumer Price Index for Urban Consumers published |
|---|
| 20 | 20 | | by the Bureau of Labor Statistics of the United States Department of |
|---|
| 21 | 21 | | Labor, to the allotment for the preceding school year, except that |
|---|
| 22 | 22 | | the basic allotment may not be set at an amount that is less than the |
|---|
| 23 | 23 | | amount of the basic allotment established by this provision. The |
|---|
| 24 | 24 | | comptroller shall, not later than the 90th day of each fiscal year, |
|---|
| 25 | 25 | | transfer to the Foundation School Fund 25 percent of any |
|---|
| 26 | 26 | | unencumbered positive balance of general revenues on the last day |
|---|
| 27 | 27 | | of the preceding fiscal year. |
|---|
| 28 | 28 | | SECTION 2 . This proposed constitutional amendment shall be |
|---|
| 29 | 29 | | submitted to the voters at an election to be held November 7, 2023. |
|---|
| 30 | 30 | | The ballot shall be printed to permit voting for or against the |
|---|
| 31 | 31 | | proposition: "The constitutional amendment setting the amount of |
|---|
| 32 | 32 | | the basic allotment under the Foundation School Program and |
|---|
| 33 | 33 | | providing for its adjustment for annual inflation." |
