55 A JOINT RESOLUTION
66 ratifying a proposed amendment to the Constitution of the United
77 States relating to the number of representatives in the United
88 States House of Representatives.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The Legislature of the State of Texas, pursuant
1111 to Article V of the United States Constitution, does hereby ratify
1212 an amendment to the Constitution of the United States proposed by
1313 resolution of the First Congress of the United States in New York,
1414 New York, on September 25, 1789, which reads as follows:
1515 "RESOLVED by the Senate and House of Representatives of the
1616 United States of America, in Congress assembled, two thirds of both
1717 Houses concurring, that the following [Article] be proposed to the
1818 Legislatures of the several States, . . . which [Article], when
1919 ratified by three fourths of the said Legislatures, to be valid to
2020 all intents and purposes, as part of the said Constitution; viz.
2121 "[An ARTICLE] in addition to, and Amendment of the
2222 Constitution of the United States of America, proposed by Congress,
2323 and ratified by the Legislatures of the several States, pursuant to
2424 the fifth Article of the original Constitution.
2525 "Article the first . . . After the first enumeration required
2626 by the first article of the Constitution, there shall be one
2727 Representative for every thirty thousand, until the number shall
2828 amount to one hundred, after which the proportion shall be so
2929 regulated by Congress, that there shall be not less than one hundred
3030 Representatives, nor less than one Representative for every forty
3131 thousand persons, until the number of Representatives shall amount
3232 to two hundred; after which the proportion shall be so regulated by
3333 Congress, that there shall not be less than two hundred
3434 Representatives, nor more than one Representative for every fifty
3535 thousand persons."
3636 SECTION 2. The Legislature of the State of Texas finds that
3737 the above-quoted article of amendment to the United States
3838 Constitution may still be ratified by the state legislatures in the
3939 same manner as the Twenty-seventh Amendment.
4040 SECTION 3. The secretary of state of this state shall:
4141 (1) notify the archivist of the United States of the
4242 action of the 88th Legislature of the State of Texas, Regular
4343 Session, 2023, by sending the archivist a copy of this resolution;
4444 (2) send copies of this resolution to the United
4545 States senators and representatives from Texas, to the vice
4646 president of the United States, and to the speaker of the United
4747 States House of Representatives with the request that it be printed
4848 in full in the Congressional Record; and
4949 (3) send copies of this resolution to the presiding
5050 officers of the legislatures of the states that have not yet
5151 ratified the proposed amendment to the United States Constitution.
