8 | 8 | | States House of Representatives. |

9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. The Legislature of the State of Texas, pursuant |
---|
11 | 11 | | to Article V of the United States Constitution, does hereby ratify |
---|
12 | 12 | | an amendment to the Constitution of the United States proposed by |
---|
13 | 13 | | resolution of the First Congress of the United States in New York, |
---|
14 | 14 | | New York, on September 25, 1789, which reads as follows: |
---|
15 | 15 | | "RESOLVED by the Senate and House of Representatives of the |
---|
16 | 16 | | United States of America, in Congress assembled, two thirds of both |
---|
17 | 17 | | Houses concurring, that the following [Article] be proposed to the |
---|
18 | 18 | | Legislatures of the several States, . . . which [Article], when |
---|
19 | 19 | | ratified by three fourths of the said Legislatures, to be valid to |
---|
20 | 20 | | all intents and purposes, as part of the said Constitution; viz. |
---|
21 | 21 | | "[An ARTICLE] in addition to, and Amendment of the |
---|
22 | 22 | | Constitution of the United States of America, proposed by Congress, |
---|
23 | 23 | | and ratified by the Legislatures of the several States, pursuant to |
---|
24 | 24 | | the fifth Article of the original Constitution. |
---|
25 | 25 | | "Article the first . . . After the first enumeration required |
---|
26 | 26 | | by the first article of the Constitution, there shall be one |
---|
27 | 27 | | Representative for every thirty thousand, until the number shall |
---|
28 | 28 | | amount to one hundred, after which the proportion shall be so |
---|
29 | 29 | | regulated by Congress, that there shall be not less than one hundred |
---|
30 | 30 | | Representatives, nor less than one Representative for every forty |
---|
31 | 31 | | thousand persons, until the number of Representatives shall amount |
---|
32 | 32 | | to two hundred; after which the proportion shall be so regulated by |
---|
33 | 33 | | Congress, that there shall not be less than two hundred |
---|
34 | 34 | | Representatives, nor more than one Representative for every fifty |
---|
35 | 35 | | thousand persons." |
---|
36 | 36 | | SECTION 2. The Legislature of the State of Texas finds that |
---|
37 | 37 | | the above-quoted article of amendment to the United States |
---|
38 | 38 | | Constitution may still be ratified by the state legislatures in the |
---|
39 | 39 | | same manner as the Twenty-seventh Amendment. |
---|
40 | 40 | | SECTION 3. The secretary of state of this state shall: |
---|
41 | 41 | | (1) notify the archivist of the United States of the |
---|
42 | 42 | | action of the 88th Legislature of the State of Texas, Regular |
---|
43 | 43 | | Session, 2023, by sending the archivist a copy of this resolution; |
---|
44 | 44 | | (2) send copies of this resolution to the United |
---|
45 | 45 | | States senators and representatives from Texas, to the vice |
---|
46 | 46 | | president of the United States, and to the speaker of the United |
---|
47 | 47 | | States House of Representatives with the request that it be printed |
---|
48 | 48 | | in full in the Congressional Record; and |
---|
49 | 49 | | (3) send copies of this resolution to the presiding |
---|
50 | 50 | | officers of the legislatures of the states that have not yet |
---|
51 | 51 | | ratified the proposed amendment to the United States Constitution. |
