88 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article XVI, Texas Constitution, is amended by
1010 adding Section 74 to read as follows:
1111 Sec. 74. (a) This state shall observe daylight saving time
1212 year-round throughout the state.
1313 (b) This section applies to all portions of the state,
1414 regardless of time zone.
1515 (c) If a court finds this state is not authorized by federal
1616 law to implement this section, Subsections (a) and (b) of this
1717 section have full force and effect on the date the United States
1818 Congress enacts legislation that becomes law that authorizes this
1919 state to observe daylight saving time as prescribed by this
2020 section.
2121 SECTION 2. This proposed constitutional amendment shall be
2222 submitted to the voters at an election to be held November 7, 2023.
2323 The ballot shall be printed to permit voting for or against the
2424 proposition: "The constitutional amendment requiring this state to
2525 observe daylight saving time year-round."
