5	5	A JOINT RESOLUTION
6	6	proposing a constitutional amendment requiring payment of child
7	7	support to be eligible to hold certain public elective offices.
8	8	BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Section 6, Article III, Texas Constitution, is
10	10	amended to read as follows:
11	11	Sec. 6. To be eligible to be a candidate for, or elected or
12	12	appointed to, the office of [No person shall be a] Senator, a person
13	13	must:
14	14	(1) [unless he] be a citizen of the United States;
15	15	(2) be, [and,] at the time of the person's [his]
16	16	election or appointment, a qualified voter of this State;
17	17	(3) [, and shall] have been a resident of this State
18	18	for the five years [next] preceding the [his] election or
19	19	appointment;
20	20	(4) have been [, and the last year thereof] a resident
21	21	of the district for which the person would serve as a Senator for
22	22	the year preceding the election or appointment;
23	23	(5) be at least 26 [he shall be chosen, and shall have
24	24	attained the age of twenty-six] years of age; and
25	25	(6) have paid all child support due and payable by the
26	26	person unless:
27	27	(A) the person has made all due payments under a
28	28	payment plan; or
29	29	(B) the child support due is being contested or
30	30	negotiated.
31	31	SECTION 2. Section 7, Article III, Texas Constitution, is
32	32	amended to read as follows:
33	33	Sec. 7. To be eligible to be a candidate for, or elected or
34	34	appointed to, the office of [No person shall be a] Representative, a
35	35	person must:
36	36	(1) [unless he] be a citizen of the United States;
37	37	(2) be, [and,] at the time of the person's [his]
38	38	election or appointment, a qualified voter of this State;
39	39	(3) [, and shall] have been a resident of this State
40	40	for the two years [next] preceding the [his] election or
41	41	appointment;
42	42	(4) have been [, the last year thereof] a resident of
43	43	the district for which the person would serve as a Representative
44	44	for the year preceding the election or appointment;
45	45	(5) be at least 21 [he shall be chosen, and shall have
46	46	attained the age of twenty-one] years of age; and
47	47	(6) have paid all child support due and payable by the
48	48	person unless:
49	49	(A) the person has made all due payments under a
50	50	payment plan; or
51	51	(B) the child support due is being contested or
52	52	negotiated.
53	53	SECTION 3. Section 4, Article IV, Texas Constitution, is
54	54	amended to read as follows:
55	55	Sec. 4. The Governor elected at the general election [in
56	56	1974, and thereafter,] shall be installed on the first Tuesday
57	57	after the organization of the Legislature, or as soon thereafter as
58	58	practicable, and shall hold that [his] office for the term of four
59	59	years, or until the Governor's [his] successor shall be duly
60	60	installed. To be eligible to be a candidate for or elected to the
61	61	office of Governor, a person must:
62	62	(1) [He shall] be at least thirty years of age;
63	63	(2) be [,] a citizen of the United States;
64	64	(3) have been a resident of [, and shall have resided
65	65	in] this State for the [at least] five years immediately preceding
66	66	the [his] election; and
67	67	(4) have paid all child support due and payable by the
68	68	person unless:
69	69	(A) the person has made all due payments under a
70	70	payment plan; or
71	71	(B) the child support due is being contested or
72	72	negotiated.
73	73	SECTION 4. This proposed constitutional amendment shall be
74	74	submitted to the voters at an election to be held November 7, 2023.
75	75	The ballot shall be printed to permit voting for or against the
76	76	proposition: "The constitutional amendment requiring payment of
77	77	child support to be eligible to hold certain public elective
78	78	offices."
