9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Article VIII, Texas Constitution, is amended by |
---|
11 | 11 | | adding Section 27 to read as follows: |
---|
12 | 12 | | Sec. 27. (a) The legislature by general law shall: |
---|
13 | 13 | | (1) require the periodic review of state and local tax |
---|
14 | 14 | | preferences; |
---|
15 | 15 | | (2) define the term "tax preference" for the purposes |
---|
16 | 16 | | of this section; and |
---|
17 | 17 | | (3) prescribe the methods, timing, and administrative |
---|
18 | 18 | | procedures for implementing the requirements of this subsection. |
---|
19 | 19 | | (b) Unless reauthorized by law: |
---|
20 | 20 | | (1) a tax preference that first takes effect on or |
---|
21 | 21 | | after September 1, 2024, expires six years after the date the law |
---|
22 | 22 | | enacting or most recently reauthorizing the tax preference takes |
---|
23 | 23 | | effect, except that the legislature may provide for an earlier |
---|
24 | 24 | | expiration date; and |
---|
25 | 25 | | (2) a tax preference that takes effect before |
---|
26 | 26 | | September 1, 2024, and that is reauthorized by law on or after that |
---|
27 | 27 | | date expires six years after the date the law most recently |
---|
28 | 28 | | reauthorizing the tax preference takes effect, except that the |
---|
29 | 29 | | legislature may provide for an earlier expiration date. |
---|
30 | 30 | | SECTION 2. The following temporary provision is added to |
---|
31 | 31 | | the Texas Constitution: |
---|
32 | 32 | | TEMPORARY PROVISION. (a) This temporary provision applies |
---|
33 | 33 | | to the constitutional amendment proposed by the 88th Legislature, |
---|
34 | 34 | | Regular Session, 2023, requiring the legislature to provide for a |
---|
35 | 35 | | periodic review of state and local tax preferences and providing |
---|
36 | 36 | | for the expiration of certain tax preferences after six years, or at |
---|
37 | 37 | | another time prescribed by the legislature, unless reauthorized by |
---|
38 | 38 | | law. |
---|
39 | 39 | | (b) Section 27, Article VIII, of this constitution, as added |
---|
40 | 40 | | by the amendment, takes effect January 1, 2024. |
---|
41 | 41 | | (c) This temporary provision expires January 2, 2024. |

42 | 42 | | SECTION 3. This proposed constitutional amendment shall be |
---|
43 | 43 | | submitted to the voters at an election to be held November 7, 2023. |
---|
44 | 44 | | The ballot shall be printed to permit voting for or against the |
---|
45 | 45 | | proposition: "The constitutional amendment requiring the |
---|
46 | 46 | | legislature to provide for a periodic review of state and local tax |
---|
47 | 47 | | preferences and providing for the expiration of certain tax |
---|
48 | 48 | | preferences after six years, or at another time prescribed by the |
---|
49 | 49 | | legislature, unless reauthorized by law." |
