66 proposing a constitutional amendment requiring the periodic review

99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article VIII, Texas Constitution, is amended by
1111 adding Section 27 to read as follows:
1212 Sec. 27. (a) The legislature by general law shall:
1313 (1) require the periodic review of state and local tax
1414 preferences;
1515 (2) define the term "tax preference" for the purposes
1616 of this section; and
1717 (3) prescribe the methods, timing, and administrative
1818 procedures for implementing the requirements of this subsection.
1919 (b) Unless reauthorized by law:
2020 (1) a tax preference that first takes effect on or
2121 after September 1, 2024, expires six years after the date the law
2222 enacting or most recently reauthorizing the tax preference takes
2323 effect, except that the legislature may provide for an earlier
2424 expiration date; and
2525 (2) a tax preference that takes effect before
2626 September 1, 2024, and that is reauthorized by law on or after that
2727 date expires six years after the date the law most recently
2828 reauthorizing the tax preference takes effect, except that the
2929 legislature may provide for an earlier expiration date.
3030 SECTION 2. The following temporary provision is added to
3131 the Texas Constitution:
3232 TEMPORARY PROVISION. (a) This temporary provision applies
3333 to the constitutional amendment proposed by the 88th Legislature,
3434 Regular Session, 2023, requiring the legislature to provide for a
3535 periodic review of state and local tax preferences and providing
3636 for the expiration of certain tax preferences after six years, or at
3737 another time prescribed by the legislature, unless reauthorized by
3838 law.
3939 (b) Section 27, Article VIII, of this constitution, as added
4040 by the amendment, takes effect January 1, 2024.
4141 (c) This temporary provision expires January 2, 2024.
4242 SECTION 3. This proposed constitutional amendment shall be
4343 submitted to the voters at an election to be held November 7, 2023.
4444 The ballot shall be printed to permit voting for or against the
4545 proposition: "The constitutional amendment requiring the
4646 legislature to provide for a periodic review of state and local tax
4747 preferences and providing for the expiration of certain tax
4848 preferences after six years, or at another time prescribed by the
4949 legislature, unless reauthorized by law."
