55 A JOINT RESOLUTION
66 proposing a constitutional amendment requiring payment of child

88 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 6, Article III, Texas Constitution, is
1010 amended to read as follows:
1111 Sec. 6. To be eligible to be [No person shall be] a Senator,
1212 a person must:
1313 (1) [unless he] be a citizen of the United States;
1414 (2) be, [and,] at the time of the person's [his]
1515 election or appointment, a qualified voter of this State;
1616 (3) [, and shall] have been a resident of this State
1717 for the five years [next] preceding the [his] election or
1818 appointment;
1919 (4) have been [, and the last year thereof] a resident
2020 of the district for which the person would serve as a Senator for
2121 the year preceding the election or appointment;
2222 (5) be at least 26 [he shall be chosen, and shall have
2323 attained the age of twenty-six] years of age; and
2424 (6) have paid all child support due and payable by the
2525 person unless:
2626 (A) the person has made all due payments under a
2727 payment plan; or
2828 (B) the child support due is being contested or
2929 negotiated.
3030 SECTION 2. Section 7, Article III, Texas Constitution, is
3131 amended to read as follows:
3232 Sec. 7. To be eligible to be [No person shall be] a
3333 Representative, a person must:
3434 (1) [unless he] be a citizen of the United States;
3535 (2) be, [and,] at the time of the person's [his]
3636 election or appointment, a qualified voter of this State;
3737 (3) [, and shall] have been a resident of this State
3838 for the two years [next] preceding the [his] election or
3939 appointment;
4040 (4) have been [, the last year thereof] a resident of
4141 the district for which the person would serve as a Representative
4242 for the year preceding the election or appointment;
4343 (5) be at least 21 [he shall be chosen, and shall have
4444 attained the age of twenty-one] years of age; and
4545 (6) have paid all child support due and payable by the
4646 person unless:
4747 (A) the person has made all due payments under a
4848 payment plan; or
4949 (B) the child support due is being contested or
5050 negotiated.
5151 SECTION 3. Section 4, Article IV, Texas Constitution, is
5252 amended to read as follows:
5353 Sec. 4. The Governor elected at the general election [in
5454 1974, and thereafter,] shall be installed on the first Tuesday
5555 after the organization of the Legislature, or as soon thereafter as
5656 practicable, and shall hold that [his] office for the term of four
5757 years, or until the Governor's [his] successor shall be duly
5858 installed. To be eligible to be Governor, a person must:
5959 (1) [He shall] be at least thirty years of age;
6060 (2) be [,] a citizen of the United States;
6161 (3) have been a resident of [, and shall have resided
6262 in] this State for the [at least] five years immediately preceding
6363 the [his] election; and
6464 (4) have paid all child support due and payable by the
6565 person unless:
6666 (A) the person has made all due payments under a
6767 payment plan; or
6868 (B) the child support due is being contested or
6969 negotiated.
7070 SECTION 4. This proposed constitutional amendment shall be
7171 submitted to the voters at an election to be held November 7, 2023.
7272 The ballot shall be printed to permit voting for or against the
7373 proposition: "The constitutional amendment requiring payment of
7474 child support to be eligible to hold the office of state
7575 representative, state senator, or governor."
