9 | 9 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Article XVI, Texas Constitution, is amended by | |
11 | 11 | adding Section 74 to read as follows: | |
12 | 12 | Sec. 74. (a) The legislature by general law may: | |
13 | 13 | (1) hold a statewide referendum that allows the voters | |
14 | 14 | to indicate a preference for or against observing daylight saving | |
15 | 15 | time year-round; and | |
16 | 16 | (2) enact a law providing for observing daylight | |
17 | 17 | saving time year-round based on the results of the referendum. | |
18 | 18 | (b) A statewide referendum described by Subsection (a) of | |
19 | 19 | this section that is held on the same day as the election on the | |
20 | 20 | constitutional amendment to add this section to this article is | |
21 | 21 | hereby validated. | |
22 | 22 | SECTION 2. This proposed constitutional amendment shall be | |
23 | 23 | submitted to the voters at an election to be held November 7, 2023. | |
24 | 24 | The ballot shall be printed to permit voting for or against the | |
25 | 25 | proposition: "The constitutional amendment authorizing the state | |
26 | 26 | to conduct a statewide referendum to allow the voters to vote for or | |
27 | 27 | against observing daylight saving time year-round and authorizing | |
28 | 28 | the legislature to enact legislation if a majority of the voters | |
29 | 29 | voting in the statewide referendum vote to observe daylight saving | |
30 | 30 | time year-round." |
