| 9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 22, Article IV, Texas Constitution, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 22. (a) The Attorney General shall represent the State |
|---|
| 13 | 13 | | in all suits and pleas in the Supreme Court of the State in which the |
|---|
| 14 | 14 | | State may be a party, and shall especially inquire into the charter |
|---|
| 15 | 15 | | rights of all private corporations, and from time to time, in the |
|---|
| 16 | 16 | | name of the State, take such action in the courts as may be proper |
|---|
| 17 | 17 | | and necessary to prevent any private corporation from exercising |
|---|
| 18 | 18 | | any power or demanding or collecting any species of taxes, tolls, |
|---|
| 19 | 19 | | freight or wharfage not authorized by law. The Attorney General |
|---|
| 20 | 20 | | [He] shall, whenever sufficient cause exists, seek a judicial |
|---|
| 21 | 21 | | forfeiture of such charters, unless otherwise expressly directed by |
|---|
| 22 | 22 | | law, and give legal advice in writing to the Governor and other |
|---|
| 23 | 23 | | executive officers, when requested by them, and perform such other |
|---|
| 24 | 24 | | duties as may be required by law. |

| 25 | 25 | | (b) The Attorney General shall have concurrent jurisdiction |
|---|
| 26 | 26 | | with each county or district attorney of this State to represent |
|---|
| 27 | 27 | | this State in the prosecution of a criminal offense prescribed by |
|---|
| 28 | 28 | | the election laws of this State. |

| 29 | 29 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 30 | 30 | | submitted to the voters at an election to be held November 7, 2023. |
|---|
| 31 | 31 | | The ballot shall be printed to provide for voting for or against the |
|---|
| 32 | 32 | | proposition: "The constitutional amendment specifying the |
|---|
| 33 | 33 | | authority of the attorney general to prosecute a criminal offense |
|---|
| 34 | 34 | | prescribed by the election laws of this state." |
