55 A JOINT RESOLUTION
66 proposing a constitutional amendment specifying the authority of
77 the attorney general to prosecute a criminal offense prescribed by
88 the election laws of this state.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 22, Article IV, Texas Constitution, is
1111 amended to read as follows:
1212 Sec. 22. (a) The Attorney General shall represent the State
1313 in all suits and pleas in the Supreme Court of the State in which the
1414 State may be a party, and shall especially inquire into the charter
1515 rights of all private corporations, and from time to time, in the
1616 name of the State, take such action in the courts as may be proper
1717 and necessary to prevent any private corporation from exercising
1818 any power or demanding or collecting any species of taxes, tolls,
1919 freight or wharfage not authorized by law. The Attorney General
2020 [He] shall, whenever sufficient cause exists, seek a judicial
2121 forfeiture of such charters, unless otherwise expressly directed by
2222 law, and give legal advice in writing to the Governor and other
2323 executive officers, when requested by them, and perform such other
2424 duties as may be required by law.
2525 (b) The Attorney General shall have concurrent jurisdiction
2626 with each county or district attorney of this State to represent
2727 this State in the prosecution of a criminal offense prescribed by
2828 the election laws of this State.
2929 SECTION 2. This proposed constitutional amendment shall be
3030 submitted to the voters at an election to be held November 7, 2023.
3131 The ballot shall be printed to provide for voting for or against the
3232 proposition: "The constitutional amendment specifying the
3333 authority of the attorney general to prosecute a criminal offense
3434 prescribed by the election laws of this state."
