| 5 | 5 | | WHEREAS, The year 2023 marks the bicentennial of the |
|---|
| 6 | 6 | | establishment of the office of constable in Texas, and this |
|---|
| 7 | 7 | | milestone anniversary provides a welcome opportunity to recognize |
|---|
| 8 | 8 | | the outstanding contributions that have been made by these law |
|---|
| 9 | 9 | | enforcement professionals through the decades; and |
|---|
| 10 | 10 | | WHEREAS, The office of constable dates back at least to the |
|---|
| 11 | 11 | | 11th century in England and was later established in the British |
|---|
| 12 | 12 | | colonies in North America; constables remained an integral |
|---|
| 13 | 13 | | component of local law enforcement following the American |
|---|
| 14 | 14 | | Revolution, and though their duties varied over time, constables |
|---|
| 15 | 15 | | were often responsible for serving warrants, arresting offenders, |
|---|
| 16 | 16 | | and generally upholding law and order; and |
|---|
| 17 | 17 | | WHEREAS, The distinguished legacy of constables in Texas |
|---|
| 18 | 18 | | began in 1823, when the area was still part of Mexico; on March 5 of |
|---|
| 19 | 19 | | that year, John Tumlinson, the alcalde of the Colorado District in |
|---|
| 20 | 20 | | Stephen F. Austin's first colony, appointed Thomas V. Alley as |
|---|
| 21 | 21 | | constable, with Tumlinson stating that Alley's duties were "to |
|---|
| 22 | 22 | | summon witnesses and bring offenders to justice"; when independence |
|---|
| 23 | 23 | | was won in 1836, the Constitution of the Republic of Texas provided |
|---|
| 24 | 24 | | for the election in each county of a sheriff and "a sufficient |
|---|
| 25 | 25 | | number of constables," and 38 constables were eventually elected in |
|---|
| 26 | 26 | | 12 counties; and |
|---|
| 27 | 27 | | WHEREAS, After Texas became a state in 1845, legislation |
|---|
| 28 | 28 | | passed by state lawmakers declared that the constable should be |
|---|
| 29 | 29 | | "the conservator of the peace throughout the county"; among their |
|---|
| 30 | 30 | | other duties, constables were required to quell "riots, routs, |
|---|
| 31 | 31 | | affrays, fighting, and unlawful assemblies" and to make arrests; |
|---|
| 32 | 32 | | during the early statehood of Texas, constables were the most |
|---|
| 33 | 33 | | active law enforcement officials in many counties; and |
|---|
| 34 | 34 | | WHEREAS, Following the Civil War, the election of county |
|---|
| 35 | 35 | | officials virtually ceased, but a major change came with the Texas |
|---|
| 36 | 36 | | Constitution of 1876, which reinstated the election of constables |
|---|
| 37 | 37 | | at the precinct level; today, constables are elected from precincts |
|---|
| 38 | 38 | | in most Texas counties, and these licensed peace officers carry out |
|---|
| 39 | 39 | | a range of essential functions, including serving warrants and |
|---|
| 40 | 40 | | civil papers, such as subpoenas and temporary restraining orders, |
|---|
| 41 | 41 | | issuing traffic citations, and serving as bailiffs for justice of |
|---|
| 42 | 42 | | the peace courts; and |
|---|
| 43 | 43 | | WHEREAS, Continuing to build on a proud and storied |
|---|
| 44 | 44 | | tradition, Texas constables play an important role in enforcing the |
|---|
| 45 | 45 | | rule of law, and it is a pleasure to join in celebrating this |
|---|
| 46 | 46 | | significant anniversary; now, therefore, be it |
|---|
| 47 | 47 | | RESOLVED, That the House of Representatives of the 88th Texas |
|---|
| 48 | 48 | | Legislature hereby commemorate the bicentennial of the |
|---|
| 49 | 49 | | establishment of the office of constable in Texas and extend |
|---|
