55 R E S O L U T I O N
66 WHEREAS, The House of Representatives of the Texas
77 Legislature has exclusive power to present articles of impeachment
88 against a state officer under Section 1, Article XV, Texas
99 Constitution, and Chapter 665, Government Code; and
1010 WHEREAS, Judge Mary Brown, Judge of the 301st Judicial
1111 District, engaged in conduct constituting abuse of a child under
1212 Section 261.001(1), Family Code, in certain judicial actions
1313 involving custody of the children of Jeff Younger; and
1414 WHEREAS, Judge Mary Brown, Judge of the 301st Judicial
1515 District, demonstrated conduct unbecoming a judge by violating the
1616 Texas Code of Judicial Conduct; now, therefore, be it
1717 RESOLVED, That the Texas House of Representatives impeach
1818 Judge Mary Brown, Judge of the 301st Judicial District; and, be it
1919 further
2020 RESOLVED, That in accordance with Section 5, Article XV,
2121 Texas Constitution, Judge Mary Brown, Judge of the 301st Judicial
2222 District, be suspended from the exercise of the duties of her office
2323 during the pendency of her impeachment, and that the governor may
2424 make a provisional appointment to fill the vacancy occasioned by
2525 the suspension of Judge Brown until the conclusion of her trial by
2626 the Senate on the impeachment charges; and, be it further
2727 RESOLVED, That the House of Representatives of the 88th Texas
2828 Legislature conduct an investigation under Section 1, Article XV,
2929 Texas Constitution, and Chapter 665, Government Code, prepare
3030 appropriate articles of impeachment against Judge Mary Brown, Judge
3131 of the 301st Judicial District, and consider those articles for
3232 presentment to the Texas Senate.
