5	5	BE IT RESOLVED by the House of Representatives of the State of
6	6	Texas, 88th Legislature, Regular Session, 2023, That House Rule 13,
7	7	Section 9(a), be suspended in part as provided by House Rule 13,
8	8	Section 9(f), to enable the conference committee appointed to
9	9	resolve the differences on Senate Bill 10 (certain benefits paid by
10	10	the Teacher Retirement System of Texas) to consider and take action
11	11	on the following matters:
12	12	(1) House Rule 13, Section 9(a)(2), is suspended to permit
13	13	the committee to omit text not in disagreement in proposed SECTION 1
14	14	of the bill, adding Section 824.703(a), Government Code, by
15	15	striking "an additional" and substituting "a".
16	16	Explanation: The change is necessary to remove unnecessary
17	17	language.
18	18	(2) House Rule 13, Sections 9(a)(3) and (4), are suspended
19	19	to permit the committee to add text on a matter not in disagreement
20	20	and not included in either the house or senate version of the bill
21	21	in proposed SECTION 1 of the bill, by adding Section 824.703(c)(3),
22	22	Government Code, to read as follows:
23	23	(3) is an alternate payee under Section 804.005, to be
24	24	eligible for the adjustment:
25	25	(A) the annuitant must be living on the effective
26	26	date of the adjustment; and
27	27	(B) the effective date of the annuitant's
28	28	election to receive the annuity payment was on or before August 31,
29	29	2020.
30	30	Explanation: The change is necessary to clarify that an
31	31	alternate payee makes the election and specify that an alternate
32	32	payee must be living on the effective date of the cost-of-living
33	33	adjustment required by the proposed bill.
34	34	(3) House Rule 13, Sections 9(a)(3) and (4), are suspended
35	35	to permit the committee to add text on a matter not in disagreement
36	36	and not included in either the house or senate version of the bill
37	37	by adding proposed SECTION 2(c) of the bill to read as follows:
38	38	(c) The amount of the supplemental payment is equal to:
39	39	(1) $7,500, if the annuitant is at least 75 years of
40	40	age on any day of the calendar month before the calendar month in
41	41	which the Teacher Retirement System of Texas issues the
42	42	supplemental payment; or
43	43	(2) $2,400, if the annuitant is:
44	44	(A) at least 70 years of age but younger than 75
45	45	years of age on any day of the calendar month before the calendar
46	46	month in which the Teacher Retirement System of Texas issues the
47	47	supplemental payment; and
48	48	(B) not subject to Subdivision (1) of this
49	49	subsection.
50	50	Explanation: The change is necessary to prescribe different
51	51	amounts for the supplemental payment required by the proposed bill
52	52	based on the age of the annuitant eligible for the payment.
