5	5	BE IT RESOLVED by the House of Representatives of the State of
6	6	Texas, 88th Legislature, Regular Session, 2023, That House Rule 13,
7	7	Section 9(a), be suspended in part as provided by House Rule 13,
8	8	Section 9(f), to enable the conference committee appointed to
9	9	resolve the differences on Senate Bill 12 (the authority to
10	10	regulate sexually oriented performances and to restricting those
11	11	performances on the premises of a commercial enterprise, on public
12	12	property, or in the presence of an individual younger than 18 years
13	13	of age; authorizing a civil penalty; creating a criminal offense)
14	14	to consider and take action on the following matter:
15	15	House Rule 13, Section 9(a)(4), is suspended to permit the
16	16	committee to add text on a matter not included in either the house
17	17	or senate version of the bill in proposed SECTION 3 of the bill, by
18	18	adding Section 43.28(a)(1)(E), Penal Code, to read as follows:
19	19	(E) the exhibition of sexual gesticulations
20	20	using accessories or prosthetics that exaggerate male or female
21	21	sexual characteristics
22	22	Explanation: The change is necessary to add additional
23	23	conduct to the definition of sexual conduct.
