| 6 | 6 | | Texas, 88th Legislature, Regular Session, 2023, That House Rule 13, |

| 7 | 7 | | Section 9(a), be suspended in part as provided by House Rule 13, |
|---|
| 8 | 8 | | Section 9(f), to enable the conference committee appointed to |
|---|
| 9 | 9 | | resolve the differences on House Bill 9 (the development and |
|---|
| 10 | 10 | | funding of broadband and telecommunications services) to consider |
|---|
| 11 | 11 | | and take action on the following matter: |
|---|
| 12 | 12 | | House Rule 13, Section 9(a)(4), is suspended to permit the |
|---|
| 13 | 13 | | committee to add text on a matter not included in either the house |
|---|
| 14 | 14 | | or senate version of the bill in proposed SECTIONS 3(a), (c), and |
|---|
| 15 | 15 | | (d) of the bill to read as follows: |
|---|
| 16 | 16 | | (a) The comptroller of public accounts shall make a one-time |
|---|
| 17 | 17 | | transfer in the amount of $155,200,000 from the broadband |
|---|
| 18 | 18 | | infrastructure fund established under Section 49-d-16, Article |
|---|
| 19 | 19 | | III, Texas Constitution, to the next generation 9-1-1 service fund |
|---|
| 20 | 20 | | established under Section 771.0713, Health and Safety Code. |
|---|
| 21 | 21 | | (c) Notwithstanding Section 5, Chapter 10 (S.B. 8), Acts of |
|---|
| 22 | 22 | | the 87th Legislature, 3rd Called Session, 2021, the comptroller of |
|---|
| 23 | 23 | | public accounts may not use funds appropriated under that section |
|---|
| 24 | 24 | | to support the Texas Broadband Pole Replacement Program established |
|---|
| 25 | 25 | | under Section 403.503, Government Code, as added by Chapter 659 |
|---|
| 26 | 26 | | (H.B. 1505), Acts of the 87th Legislature, Regular Session, 2021, |
|---|
| 27 | 27 | | after the effective date of this Act. |
|---|
| 28 | 28 | | (d) The comptroller of public accounts shall transfer the |
|---|
| 29 | 29 | | amounts described by Subsections (a) and (b) of this section not |
|---|
| 30 | 30 | | later than September 15, 2024. |

| 31 | 31 | | Explanation: The added text would require the comptroller of |
|---|
| 32 | 32 | | public accounts to make a one-time transfer from the broadband |
|---|
| 33 | 33 | | infrastructure fund to the next generation 9-1-1 service fund, |
