5	5	relating to disclosure requirements for health care provider
6	6	directories maintained by certain health benefit plan issuers.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 1451.501(1-a), Insurance Code, is
9	9	amended to read as follows:
10	10	(1-a) "Facility-based physician or provider" means a
11	11	physician or health care provider [radiologist, anesthesiologist,
12	12	pathologist, emergency department physician, neonatologist, or
13	13	assistant surgeon]:
14	14	(A) to whom a facility has granted clinical
15	15	privileges; and
16	16	(B) who provides services to patients of the
17	17	facility under those clinical privileges.
18	18	SECTION 2. Section 1451.504, Insurance Code, is amended by
19	19	amending Subsections (c) and (d) and adding Subsection (e) to read
20	20	as follows:
21	21	(c) Except as provided by Subsection (e), for [For] each
22	22	health care provider that is a facility included in the directory
23	23	under this section, the directory must:
24	24	(1) list under the facility name separate headings for
25	25	specialties, including radiologists, anesthesiologists, nurse
26	26	anesthetists, anesthesiologist assistants, pathologists,
27	27	emergency department physicians, neonatologists, nurse midwives,
28	28	surgical assistants, physical therapists, occupational therapists,
29	29	speech-language pathologists, and any other specialty identified
30	30	by commissioner rule [and assistant surgeons];
31	31	(2) list under each heading described by Subdivision
32	32	(1) each facility-based physician or provider described by
33	33	Subsection (a) practicing in the specialty corresponding with that
34	34	heading that is a preferred provider, exclusive provider, or
35	35	network physician or provider;
36	36	(3) for the facility and each facility-based physician
37	37	or provider described by Subdivision (2), clearly indicate each
38	38	health benefit plan issued by the issuer that may provide coverage
39	39	for the services provided by that facility or facility-based
40	40	physician or provider; and
41	41	(4) include the facility in a listing of all
42	42	facilities included in the directory indicating:
43	43	(A) the name of the facility;
44	44	(B) the municipality in which the facility is
45	45	located or county in which the facility is located if the facility
46	46	is in the unincorporated area of the county;
47	47	(C) for each specialty of facility-based
48	48	physician or provider practicing at the facility, the name, street
49	49	address, and telephone number of any facility-based physician or
50	50	provider that is a preferred provider, exclusive provider, or
51	51	network physician or provider or of the physician or provider group
52	52	in which the facility-based physician or provider practices;
53	53	(D) each health benefit plan issued by the issuer
54	54	that may provide coverage for the services provided by the
55	55	facility; and
56	56	(E) each health benefit plan issued by the issuer
57	57	that may provide coverage for the services provided by each
58	58	facility-based physician or provider group.
59	59	(d) The directory must list a facility-based physician or
60	60	provider individually and, if the physician or provider belongs to
61	61	a physician or provider group, as part of the physician or provider
62	62	group.
63	63	(e) The directory is not required to list a physician or
64	64	health care provider who is employed by the facility.
65	65	SECTION 3. A health benefit plan issuer shall update the
66	66	issuer's physician and health care provider directory and Internet
67	67	website to conform with Subchapter K, Chapter 1451, Insurance Code,
68	68	as amended by this Act, not later than January 1, 2024.
69	69	SECTION 4. This Act takes effect September 1, 2023.
