55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to regulation of massage therapists and massage
88 establishments by political subdivisions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 455.005, Occupations Code, is amended by
1111 amending Subsections (b) and (c) and adding Subsection (e) to read
1212 as follows:
1313 (b) Subject to Subsection (c), this [This] chapter does not
1414 affect a local regulation that:
1515 (1) relates to:
1616 (A) zoning requirements, including conditional
1717 use permits;
1818 (B) hours of operation; or
1919 (C) other [similar] regulations similar to those
2020 described by Paragraph (A) or (B) for massage establishments;
2121 (2) authorizes or requires an investigation into the
2222 background of an owner or operator of, or an investor in, a massage
2323 establishment; or
2424 (3) does not relate directly to the practice of
2525 massage therapy as performed by a licensed massage therapist,
2626 including a regulation related to a license holder listed in
2727 Section 455.004, while the therapist:
2828 (A) performs under the applicable licensing law;
2929 and
3030 (B) works with a licensed massage therapist.
3131 (c) A [Except as provided by Chapter 243, Local Government
3232 Code, a] political subdivision may not adopt a regulation of the
3333 type described by Subsection (b) that is more restrictive for
3434 massage therapists or massage establishments than for other health
3535 care professionals or establishments, except that a more
3636 restrictive regulation of the type described by Subsection (b) may
3737 be adopted:
3838 (1) as provided by Chapter 243, Local Government Code;
3939 (2) if regulating the hours of operation of a massage
4040 therapist or massage establishment; or
4141 (3) if the regulation relates to the ownership or
4242 operation of a massage establishment, or the provision of massage
4343 therapy, by a person:
4444 (A) who has on three or more occasions been
4545 arrested or issued a citation in lieu of arrest for an offense under
4646 Section 43.02, 43.021, 43.03, 43.04, 43.05, or 71.02, Penal Code;
4747 (B) who has been convicted of an offense under
4848 Chapter 20A, or Section 34.02, 43.02, 43.021, 43.03, 43.04, 43.05,
4949 or 71.02, Penal Code;
5050 (C) against whom a sanction has been imposed for
5151 a violation of this chapter; or
5252 (D) who has owned or operated a massage
5353 establishment against which a sanction has been imposed for a
5454 violation for this chapter.
5555 (e) In this section, "sanction" has the meaning assigned by
5656 Section 51.001.
5757 SECTION 2. This Act takes effect September 1, 2023.
