7 | 7 | | relating to regulation of massage therapists and massage |

8 | 8 | | establishments by political subdivisions. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 455.005, Occupations Code, is amended by |
---|
11 | 11 | | amending Subsections (b) and (c) and adding Subsection (e) to read |
---|
12 | 12 | | as follows: |
---|
13 | 13 | | (b) Subject to Subsection (c), this [This] chapter does not |
---|
14 | 14 | | affect a local regulation that: |
---|
15 | 15 | | (1) relates to: |
---|
16 | 16 | | (A) zoning requirements, including conditional |
---|
17 | 17 | | use permits; |
---|
18 | 18 | | (B) hours of operation; or |
---|
19 | 19 | | (C) other [similar] regulations similar to those |
---|
20 | 20 | | described by Paragraph (A) or (B) for massage establishments; |
---|
21 | 21 | | (2) authorizes or requires an investigation into the |
---|
22 | 22 | | background of an owner or operator of, or an investor in, a massage |
---|
23 | 23 | | establishment; or |
---|
24 | 24 | | (3) does not relate directly to the practice of |
---|
25 | 25 | | massage therapy as performed by a licensed massage therapist, |
---|
26 | 26 | | including a regulation related to a license holder listed in |
---|
27 | 27 | | Section 455.004, while the therapist: |
---|
28 | 28 | | (A) performs under the applicable licensing law; |
---|
29 | 29 | | and |
---|
30 | 30 | | (B) works with a licensed massage therapist. |
---|
31 | 31 | | (c) A [Except as provided by Chapter 243, Local Government |
---|
32 | 32 | | Code, a] political subdivision may not adopt a regulation of the |
---|
33 | 33 | | type described by Subsection (b) that is more restrictive for |
---|
34 | 34 | | massage therapists or massage establishments than for other health |
---|
35 | 35 | | care professionals or establishments, except that a more |
---|
36 | 36 | | restrictive regulation of the type described by Subsection (b) may |
---|
37 | 37 | | be adopted: |
---|
38 | 38 | | (1) as provided by Chapter 243, Local Government Code; |
---|
39 | 39 | | (2) if regulating the hours of operation of a massage |
---|
40 | 40 | | therapist or massage establishment; or |
---|
41 | 41 | | (3) if the regulation relates to the ownership or |
---|
42 | 42 | | operation of a massage establishment, or the provision of massage |
---|
43 | 43 | | therapy, by a person: |
---|
44 | 44 | | (A) who has on three or more occasions been |
---|
45 | 45 | | arrested or issued a citation in lieu of arrest for an offense under |
---|
46 | 46 | | Section 43.02, 43.021, 43.03, 43.04, 43.05, or 71.02, Penal Code; |
---|
47 | 47 | | (B) who has been convicted of an offense under |
---|
48 | 48 | | Chapter 20A, or Section 34.02, 43.02, 43.021, 43.03, 43.04, 43.05, |
---|
49 | 49 | | or 71.02, Penal Code; |
---|
50 | 50 | | (C) against whom a sanction has been imposed for |
---|
51 | 51 | | a violation of this chapter; or |
---|
52 | 52 | | (D) who has owned or operated a massage |
---|
53 | 53 | | establishment against which a sanction has been imposed for a |
---|
54 | 54 | | violation for this chapter. |
---|
55 | 55 | | (e) In this section, "sanction" has the meaning assigned by |
---|
56 | 56 | | Section 51.001. |
---|
57 | 57 | | SECTION 2. This Act takes effect September 1, 2023. |
