| 7 | 7 | | relating to the creation of a limited term driver's license; |
|---|
| 8 | 8 | | authorizing fees. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Chapter 521, Transportation Code, is amended by |
|---|
| 11 | 11 | | adding Subchapter K-1 to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER K-1. LIMITED TERM DRIVER'S LICENSE |
|---|
| 13 | 13 | | Sec. 521.231. ELIGIBILITY. The department may issue a |
|---|
| 14 | 14 | | limited term driver's license, including a learner license or a |
|---|
| 15 | 15 | | provisional license, to an applicant who: |
|---|
| 16 | 16 | | (1) as of the date the license is issued, has resided |
|---|
| 17 | 17 | | in this state for at least one year; |
|---|
| 18 | 18 | | (2) meets the requirements for the license other than |
|---|
| 19 | 19 | | an application requirement described by Section 521.235; and |
|---|
| 20 | 20 | | (3) provides to the department either: |
|---|
| 21 | 21 | | (A) a social security number; or |
|---|
| 22 | 22 | | (B) an individual taxpayer identification number |
|---|
| 23 | 23 | | issued by the Internal Revenue Service. |
|---|
| 24 | 24 | | Sec. 521.232. NOT TO BE USED AS IDENTIFICATION FOR FEDERAL |
|---|
| 25 | 25 | | OR VOTING PURPOSES. A limited term driver's license issued under |
|---|
| 26 | 26 | | this subchapter is not valid as proof of the license holder's |
|---|
| 27 | 27 | | identity for any federal purposes or for purposes of voting in any |
|---|
| 28 | 28 | | election, including a national, state, or local election. |
|---|
| 29 | 29 | | Sec. 521.233. LIMITED TERM DRIVER'S LICENSE. (a) The |
|---|
| 30 | 30 | | department shall: |
|---|
| 31 | 31 | | (1) designate and clearly mark as a limited term |
|---|
| 32 | 32 | | driver's license each license issued under this subchapter; and |
|---|
| 33 | 33 | | (2) include on a license issued under this subchapter |
|---|
| 34 | 34 | | an indication that the license is not valid proof of identity for |
|---|
| 35 | 35 | | any federal or voting purposes. |
|---|
| 36 | 36 | | (b) Except as otherwise provided by this subchapter, the |
|---|
| 37 | 37 | | provisions of this chapter and other law applicable to the issuance |
|---|
| 38 | 38 | | or renewal of, an applicant or application for, or a holder of a |
|---|
| 39 | 39 | | driver's license, including a provisional license or learner |
|---|
| 40 | 40 | | license, are applicable to the issuance or renewal of, an applicant |
|---|
| 41 | 41 | | or application for, or a holder of a limited term driver's license. |
|---|
| 42 | 42 | | Sec. 521.234. RULES. (a) The department shall adopt rules |
|---|
| 43 | 43 | | to implement this subchapter, including rules: |
|---|
| 44 | 44 | | (1) regarding the design and content of the limited |
|---|
| 45 | 45 | | term driver's license; and |
|---|
| 46 | 46 | | (2) establishing criteria for proof of identification |
|---|
| 47 | 47 | | and residency of an applicant. |
|---|
| 48 | 48 | | (b) Rules establishing criteria for proof of identification |
|---|
| 49 | 49 | | must allow an applicant to establish identity through presentation |
|---|
| 50 | 50 | | of a foreign birth certificate or unexpired foreign passport that |
|---|
| 51 | 51 | | includes a certified translation if the document is not in English. |
|---|
| 52 | 52 | | Sec. 521.235. CERTAIN APPLICATION PROVISIONS INAPPLICABLE. |
|---|
| 53 | 53 | | The following provisions do not apply to an application for the |
|---|
| 54 | 54 | | issuance or renewal of a limited term driver's license: |
|---|
| 55 | 55 | | (1) notwithstanding Section 521.1425, the requirement |
|---|
| 56 | 56 | | in Section 521.142(a) that an applicant who is not a citizen of the |
|---|
| 57 | 57 | | United States present to the department documentation that |
|---|
| 58 | 58 | | authorizes the applicant to be in the United States; and |
|---|
| 59 | 59 | | (2) Sections 521.142(c)(7) and (g). |
|---|
| 60 | 60 | | Sec. 521.236. EXPIRATION. Notwithstanding Sections |
|---|
| 61 | 61 | | 521.271 and 521.2711: |
|---|
| 62 | 62 | | (1) each limited term driver's license issued or |
|---|
| 63 | 63 | | renewed under this subchapter expires on the third birthday of the |
|---|
| 64 | 64 | | license holder occurring after the date of issuance or renewal; and |
|---|
| 65 | 65 | | (2) each provisional limited term driver's license and |
|---|
| 66 | 66 | | limited term learner license issued under this subchapter expires |
|---|
| 67 | 67 | | on the 18th birthday of the license holder. |
|---|
| 68 | 68 | | SECTION 2. Section 521.421, Transportation Code, is amended |
|---|
| 69 | 69 | | by adding Subsections (l) and (m) to read as follows: |
|---|
| 70 | 70 | | (l) Except as provided by Subsection (m), the fee for |
|---|
| 71 | 71 | | issuance or renewal of a limited term driver's license is $25. |
|---|
| 72 | 72 | | (m) The fee for issuance of a provisional limited term |
|---|
| 73 | 73 | | driver's license or limited term learner license is $16. |
|---|
| 74 | 74 | | SECTION 3. Not later than January 1, 2024, the Department of |
|---|
| 75 | 75 | | Public Safety of the State of Texas shall adopt the rules necessary |
|---|
| 76 | 76 | | to implement Subchapter K-1, Chapter 521, Transportation Code, as |
|---|
| 77 | 77 | | added by this Act. |
|---|
| 78 | 78 | | SECTION 4. This Act takes effect September 1, 2023. |
