77 relating to the creation of a limited term driver's license;
88 authorizing fees.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 521, Transportation Code, is amended by
1111 adding Subchapter K-1 to read as follows:
1212 SUBCHAPTER K-1. LIMITED TERM DRIVER'S LICENSE
1313 Sec. 521.231. ELIGIBILITY. The department may issue a
1414 limited term driver's license, including a learner license or a
1515 provisional license, to an applicant who:
1616 (1) as of the date the license is issued, has resided
1717 in this state for at least one year;
1818 (2) meets the requirements for the license other than
1919 an application requirement described by Section 521.235; and
2020 (3) provides to the department either:
2121 (A) a social security number; or
2222 (B) an individual taxpayer identification number
2323 issued by the Internal Revenue Service.
2424 Sec. 521.232. NOT TO BE USED AS IDENTIFICATION FOR FEDERAL
2525 OR VOTING PURPOSES. A limited term driver's license issued under
2626 this subchapter is not valid as proof of the license holder's
2727 identity for any federal purposes or for purposes of voting in any
2828 election, including a national, state, or local election.
2929 Sec. 521.233. LIMITED TERM DRIVER'S LICENSE. (a) The
3030 department shall:
3131 (1) designate and clearly mark as a limited term
3232 driver's license each license issued under this subchapter; and
3333 (2) include on a license issued under this subchapter
3434 an indication that the license is not valid proof of identity for
3535 any federal or voting purposes.
3636 (b) Except as otherwise provided by this subchapter, the
3737 provisions of this chapter and other law applicable to the issuance
3838 or renewal of, an applicant or application for, or a holder of a
3939 driver's license, including a provisional license or learner
4040 license, are applicable to the issuance or renewal of, an applicant
4141 or application for, or a holder of a limited term driver's license.
4242 Sec. 521.234. RULES. (a) The department shall adopt rules
4343 to implement this subchapter, including rules:
4444 (1) regarding the design and content of the limited
4545 term driver's license; and
4646 (2) establishing criteria for proof of identification
4747 and residency of an applicant.
4848 (b) Rules establishing criteria for proof of identification
4949 must allow an applicant to establish identity through presentation
5050 of a foreign birth certificate or unexpired foreign passport that
5151 includes a certified translation if the document is not in English.
5252 Sec. 521.235. CERTAIN APPLICATION PROVISIONS INAPPLICABLE.
5353 The following provisions do not apply to an application for the
5454 issuance or renewal of a limited term driver's license:
5555 (1) notwithstanding Section 521.1425, the requirement
5656 in Section 521.142(a) that an applicant who is not a citizen of the
5757 United States present to the department documentation that
5858 authorizes the applicant to be in the United States; and
5959 (2) Sections 521.142(c)(7) and (g).
6060 Sec. 521.236. EXPIRATION. Notwithstanding Sections
6161 521.271 and 521.2711:
6262 (1) each limited term driver's license issued or
6363 renewed under this subchapter expires on the third birthday of the
6464 license holder occurring after the date of issuance or renewal; and
6565 (2) each provisional limited term driver's license and
6666 limited term learner license issued under this subchapter expires
6767 on the 18th birthday of the license holder.
6868 SECTION 2. Section 521.421, Transportation Code, is amended
6969 by adding Subsections (l) and (m) to read as follows:
7070 (l) Except as provided by Subsection (m), the fee for
7171 issuance or renewal of a limited term driver's license is $25.
7272 (m) The fee for issuance of a provisional limited term
7373 driver's license or limited term learner license is $16.
7474 SECTION 3. Not later than January 1, 2024, the Department of
7575 Public Safety of the State of Texas shall adopt the rules necessary
7676 to implement Subchapter K-1, Chapter 521, Transportation Code, as
7777 added by this Act.
7878 SECTION 4. This Act takes effect September 1, 2023.
