8 | 8 | | be provided by a juvenile justice alternative education program. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 37.011(f), Education Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (f) A juvenile justice alternative education program must |
---|
13 | 13 | | provide [operate] at least 43,200 minutes of instructional time |
---|
14 | 14 | | [seven hours per day and 180 days] per year, except that a program |
---|
15 | 15 | | may apply to the Texas Juvenile Justice Department for a waiver of |
---|
16 | 16 | | the instructional time [180-day] requirement. The department may |
---|
17 | 17 | | not grant a waiver to a program under this subsection for a number |
---|
18 | 18 | | of minutes [days] that exceeds the highest number of instructional |
---|
19 | 19 | | minutes [days] waived by the commissioner during the same school |
---|
20 | 20 | | year for any [a] school district served by the program. |
---|
21 | 21 | | SECTION 2. This Act applies beginning with the 2023-2024 |
---|
22 | 22 | | school year. |
---|
23 | 23 | | SECTION 3. This Act takes effect immediately if it receives |
---|
24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
---|
25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
---|
27 | 27 | | Act takes effect September 1, 2023. |
