55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the required number of minutes of instructional time to
88 be provided by a juvenile justice alternative education program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.011(f), Education Code, is amended to
1111 read as follows:
1212 (f) A juvenile justice alternative education program must
1313 provide [operate] at least 43,200 minutes of instructional time
1414 [seven hours per day and 180 days] per year, except that a program
1515 may apply to the Texas Juvenile Justice Department for a waiver of
1616 the instructional time [180-day] requirement. The department may
1717 not grant a waiver to a program under this subsection for a number
1818 of minutes [days] that exceeds the highest number of instructional
1919 minutes [days] waived by the commissioner during the same school
2020 year for any [a] school district served by the program.
2121 SECTION 2. This Act applies beginning with the 2023-2024
2222 school year.
2323 SECTION 3. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2023.
