| 5 | 5 | | relating to funding and activities of the Texas Produced Water |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 8 | 8 | | SECTION 1. Section 109.205(c), Education Code, is repealed. |
|---|
| 9 | 9 | | SECTION 2. (a) In this section, "consortium" means the |
|---|
| 10 | 10 | | Texas Produced Water Consortium established by Subchapter E, |
|---|
| 11 | 11 | | Chapter 109, Education Code. |
|---|
| 12 | 12 | | (b) Not later than October 1, 2023, the consortium shall |
|---|
| 13 | 13 | | select a pilot project or program for consideration and |
|---|
| 14 | 14 | | implementation. |
|---|
| 15 | 15 | | (c) Not later than October 1, 2024, the consortium shall |
|---|
| 16 | 16 | | submit to the legislature a report regarding: |
|---|
| 17 | 17 | | (1) the status of the pilot project or program |
|---|
| 18 | 18 | | selected under Subsection (b) of this section; and |
|---|
| 19 | 19 | | (2) any suggested policy, regulatory, or legislative |
|---|
| 20 | 20 | | changes resulting from an analysis of the implementation of the |
|---|
| 21 | 21 | | pilot project or program selected under Subsection (b) of this |
|---|
| 22 | 22 | | section. |
|---|
| 23 | 23 | | (d) The consortium is required to implement a provision of |
|---|
| 24 | 24 | | this section only if the legislature appropriates money |
|---|
| 25 | 25 | | specifically for that purpose. If the legislature does not |
|---|
| 26 | 26 | | appropriate money specifically for that purpose, the consortium |
|---|
| 27 | 27 | | may, but is not required to, implement the provision using other |
|---|
| 28 | 28 | | money available to the consortium for that purpose. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2023. |
