66 AN ACT
77 relating to gas utility alternative gas expenses and infrastructure
88 investments.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 104, Utilities Code, is
1111 amended by adding Section 104.061 to read as follows:
1212 Sec. 104.061. CONSIDERATION OF ALTERNATIVE GAS EXPENSES AND
1313 INFRASTRUCTURE INVESTMENTS. (a) In this section, "alternative
1414 gas" means:
1515 (1) any pipeline-compatible gaseous fuel that is
1616 derived from:
1717 (A) the anaerobic digestion of biomass,
1818 gasification of biomass, or another biomass conversion process;
1919 (B) agricultural waste; or
2020 (C) landfill gas;
2121 (2) hydrogen produced using:
2222 (A) carbon capture and storage;
2323 (B) renewable energy to break down water into
2424 hydrogen and oxygen through electrolysis; or
2525 (C) the breakdown of methane into hydrogen and
2626 solid carbon through pyrolysis;
2727 (3) gas certified in a manner approved by the railroad
2828 commission under Subsection (b); or
2929 (4) another gaseous fuel designated by the railroad
3030 commission under Subsection (b).
3131 (b) The railroad commission by rule may:
3232 (1) approve a certification process used by an
3333 organization to certify that a type of gas has a lower carbon
3434 content than natural gas; and
3535 (2) designate a gaseous fuel as an alternative gas if
3636 the fuel has a lower carbon content than natural gas.
3737 (c) A gas utility may include one or more forms of purchased
3838 alternative gas in its gas supply portfolio used for the provision
3939 of gas service to the public. When establishing a gas utility's
4040 rates, the regulatory authority shall allow a gas utility to
4141 recover as a cost or expense expenditures associated with
4242 purchasing the alternative gas.
4343 (d) When reviewing a gas utility's expenses, the regulatory
4444 authority shall presume that purchases of alternative gas under
4545 Subsection (c) are prudent, reasonable, and necessary gas expenses.
4646 (e) A gas utility may invest in infrastructure to acquire,
4747 interconnect with, or produce alternative gas supply for its
4848 customers. When establishing a gas utility's rates, the regulatory
4949 authority shall allow a gas utility to include in its invested
5050 capital the infrastructure costs.
5151 (f) The regulatory authority shall presume that an
5252 infrastructure investment under Subsection (e) is used and useful
5353 in providing service to the public and a prudent, reasonable, and
5454 necessary investment.
5555 SECTION 2. This Act takes effect September 1, 2023.
