5	5	relating to a uniform coordination of benefits questionnaire for
6	6	health benefit plans.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Chapter 1203, Insurance Code, is amended by
9	9	adding Subchapter C to read as follows:
10	10	SUBCHAPTER C. COORDINATION OF BENEFITS QUESTIONNAIRE
11	11	Sec. 1203.101. APPLICABILITY OF SUBCHAPTER. (a) This
12	12	subchapter applies only to a health benefit plan that provides
13	13	benefits for medical or surgical expenses incurred as a result of a
14	14	health condition, accident, or sickness, including an individual,
15	15	group, blanket, or franchise insurance policy or insurance
16	16	agreement, a group hospital service contract, or an individual or
17	17	group evidence of coverage or similar coverage document that is
18	18	issued by:
19	19	(1) an insurance company;
20	20	(2) a group hospital service corporation operating
21	21	under Chapter 842;
22	22	(3) a health maintenance organization operating under
23	23	Chapter 843;
24	24	(4) an approved nonprofit health corporation that
25	25	holds a certificate of authority under Chapter 844;
26	26	(5) a multiple employer welfare arrangement that holds
27	27	a certificate of authority under Chapter 846;
28	28	(6) a stipulated premium company operating under
29	29	Chapter 884;
30	30	(7) a Lloyd's plan operating under Chapter 941; or
31	31	(8) an exchange operating under Chapter 942.
32	32	(b) Notwithstanding any other law, this subchapter applies
33	33	to:
34	34	(1) a small employer health benefit plan subject to
35	35	Chapter 1501, including coverage provided through a health group
36	36	cooperative under Subchapter B of that chapter;
37	37	(2) a standard health benefit plan issued under
38	38	Chapter 1507;
39	39	(3) a basic coverage plan under Chapter 1551;
40	40	(4) a basic plan under Chapter 1575;
41	41	(5) a primary care coverage plan under Chapter 1579;
42	42	(6) a plan providing basic coverage under Chapter
43	43	1601;
44	44	(7) alternative health benefit coverage offered by a
45	45	subsidiary of the Texas Mutual Insurance Company under Subchapter
46	46	M, Chapter 2054;
47	47	(8) group health coverage made available by a school
48	48	district in accordance with Section 22.004, Education Code;
49	49	(9) the state Medicaid program, including the Medicaid
50	50	managed care program operated under Chapter 533, Government Code;
51	51	(10) the child health plan program under Chapter 62,
52	52	Health and Safety Code;
53	53	(11) a regional or local health care program operated
54	54	under Section 75.104, Health and Safety Code; and
55	55	(12) a self-funded health benefit plan sponsored by a
56	56	professional employer organization under Chapter 91, Labor Code.
57	57	Sec. 1203.102. CREATION OF UNIFORM COORDINATION OF BENEFITS
58	58	QUESTIONNAIRE. In collaboration with appropriate stakeholders,
59	59	the commissioner shall adopt rules establishing a uniform
60	60	coordination of benefits questionnaire to be used by all health
61	61	benefit plan issuers in this state.
62	62	Sec. 1203.103. UNIFORM COORDINATION OF BENEFITS
63	63	QUESTIONNAIRE REQUIRED. Each health benefit plan issuer that
64	64	issues a health benefit plan that includes a coordination of
65	65	benefits provision shall use the uniform coordination of benefits
66	66	questionnaire established under Section 1203.102 and make the
67	67	questionnaire available to health care providers as appropriate.
68	68	SECTION 2. (a) Not later than January 1, 2024, the
69	69	commissioner of insurance shall adopt rules establishing the
70	70	uniform coordination of benefits questionnaire under Section
71	71	1203.102, Insurance Code, as added by this Act.
72	72	(b) The changes in law made by this Act apply only to the use
73	73	of a coordination of benefits questionnaire on or after February 1,
74	74	2024.
75	75	SECTION 3. This Act takes effect September 1, 2023.
