55 relating to requirements for a trial in the contest of an election
66 on a proposed constitutional amendment.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 233.014, Election Code, is amended by
99 amending Subsection (d) and adding Subsection (h) to read as
1010 follows:
1111 (d) The trial date may not be earlier than the 45th day after
1212 the date of the contested election nor later than the 180th day
1313 after the date of the contested election. The trial date may be
1414 earlier than the 45th day after the date of the contested election
1515 at the request of [unless] the contestant [requests an earlier
1616 date].
1717 (h) If a contestant files an appeal of the contest, the
1818 appellate court must ensure that the action is brought to final
1919 disposition not later than the 180th day after the date the judgment
2020 becomes final.
2121 SECTION 2. This Act takes effect September 1, 2023.
