| 5 | 5 | | relating to the authority of certain municipalities and local |

| 6 | 6 | | government corporations to use certain tax revenue for certain |

| 7 | 7 | | qualified projects. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 351.1015, Tax Code, is amended by |
|---|
| 10 | 10 | | amending Subsection (b) and adding Subsection (j) to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | (b) This section applies only to a qualified project located |
|---|
| 13 | 13 | | in: |
|---|
| 14 | 14 | | (1) a municipality with a population of at least |
|---|
| 15 | 15 | | 650,000 but less than 750,000 according to the most recent federal |
|---|
| 16 | 16 | | decennial census; or |
|---|
| 17 | 17 | | (2) a municipality with a population of at least two |
|---|
| 18 | 18 | | million. |
|---|
| 19 | 19 | | (j) A local government corporation to which this subsection |
|---|
| 20 | 20 | | applies may act as a municipality under this section and is |
|---|
| 21 | 21 | | considered to be a municipality for purposes of this section. With |
|---|
| 22 | 22 | | respect to a local government corporation to which this subsection |
|---|
| 23 | 23 | | applies, the term "qualified project" includes a venue and any |
|---|
| 24 | 24 | | related infrastructure. This subsection applies only to a local |
|---|
| 25 | 25 | | government corporation that: |
|---|
| 26 | 26 | | (1) is authorized to collect a municipal hotel |
|---|
| 27 | 27 | | occupancy tax; and |
|---|
| 28 | 28 | | (2) is located in a county with a population of 3.3 |
|---|
| 29 | 29 | | million or more. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect September 1, 2023. |
