44 AN ACT
55 relating to the authority of certain municipalities and local
66 government corporations to use certain tax revenue for certain
77 qualified projects.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 351.1015, Tax Code, is amended by
1010 amending Subsection (b) and adding Subsection (j) to read as
1111 follows:
1212 (b) This section applies only to a qualified project located
1313 in:
1414 (1) a municipality with a population of at least
1515 650,000 but less than 750,000 according to the most recent federal
1616 decennial census; or
1717 (2) a municipality with a population of at least two
1818 million.
1919 (j) A local government corporation to which this subsection
2020 applies may act as a municipality under this section and is
2121 considered to be a municipality for purposes of this section. With
2222 respect to a local government corporation to which this subsection
2323 applies, the term "qualified project" includes a venue and any
2424 related infrastructure. This subsection applies only to a local
2525 government corporation that:
2626 (1) is authorized to collect a municipal hotel
2727 occupancy tax; and
2828 (2) is located in a county with a population of 3.3
2929 million or more.
3030 SECTION 2. This Act takes effect September 1, 2023.
