66 AN ACT
77 relating to requiring the inclusion of certain proposals in reports
88 on the actuarial experience of the Employees Retirement System of
99 Texas and the Teacher Retirement System of Texas.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 815.206, Government Code, is amended by
1212 adding Subsection (c-1) to read as follows:
1313 (c-1) An actuarial experience study or other report on an
1414 actuarial investigation of mortality, service, and compensation
1515 experience conducted under Subsection (c) must include at least one
1616 proposal that seeks to achieve or maintain an amortization period
1717 not exceeding 30 years by one or more years without additional or
1818 increased contributions from the state. The proposal may include:
1919 (1) changes to benefits;
2020 (2) requiring increased or additional contributions
2121 from members or the members' employers; or
2222 (3) reasonable changes to the assumed rate of return
2323 on investments.
2424 SECTION 2. Section 825.206, Government Code, is amended by
2525 adding Subsection (e-1) to read as follows:
2626 (e-1) An actuarial experience study or other report on an
2727 actuarial investigation of mortality, service, and compensation
2828 experience conducted under Subsection (b) must include at least one
2929 proposal that seeks to achieve or maintain an amortization period
3030 not exceeding 30 years by one or more years without additional or
3131 increased contributions from the state. The proposal may include:
3232 (1) changes to benefits;
3333 (2) requiring increased or additional contributions
3434 from members or the members' employers; or
3535 (3) reasonable changes to the assumed rate of return
3636 on investments.
3737 SECTION 3. This Act takes effect September 1, 2023.
