| 7 | 7 | | relating to the filing and publishing of lobbyist activity reports. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 305.006, Government Code, is amended by |
|---|
| 10 | 10 | | adding Subsection (h) to read as follows: |
|---|
| 11 | 11 | | (h) The report must also contain a list of all legislation |
|---|
| 12 | 12 | | for which the registrant communicated directly with a member of the |
|---|
| 13 | 13 | | legislative branch to influence the member's position on the |
|---|
| 14 | 14 | | legislation or for which the registrant submitted a sworn statement |
|---|
| 15 | 15 | | to a committee of the legislature during the preceding month. |
|---|
| 16 | 16 | | SECTION 2. Section 305.007, Government Code, is amended to |
|---|
| 17 | 17 | | read as follows: |
|---|
| 18 | 18 | | Sec. 305.007. FILING DATES FOR SUPPLEMENTAL REPORTS. (a) |
|---|
| 19 | 19 | | The registrant must file the report required by Section 305.006 not |
|---|
| 20 | 20 | | later than [between] the first [1st and 10th] day of each month. |
|---|
| 21 | 21 | | Subject to Section 305.0071, the report must cover the activities |
|---|
| 22 | 22 | | occurring during the previous month. |
|---|
| 23 | 23 | | (b) A person who made expenditures on the registrant's |
|---|
| 24 | 24 | | behalf that are required to be reported under Section 305.006 or a |
|---|
| 25 | 25 | | person who has other information that is required to be reported by |
|---|
| 26 | 26 | | the registrant under this chapter shall provide a full, verified |
|---|
| 27 | 27 | | account of the expenditures to the registrant not later than the |
|---|
| 28 | 28 | | [seventh day before the] date on which the registrant's report is |
|---|
| 29 | 29 | | due. |
|---|
| 30 | 30 | | SECTION 3. Section 305.0071(a), Government Code, is amended |
|---|
| 31 | 31 | | to read as follows: |
|---|
| 32 | 32 | | (a) Except as provided by this section,[: |
|---|
| 33 | 33 | | [(1)] an expenditure is not required to be included in a |
|---|
| 34 | 34 | | report under Section 305.006 for a month before the month in which |
|---|
| 35 | 35 | | the amount is readily determinable by the person making the |
|---|
| 36 | 36 | | expenditure [; and |
|---|
| 37 | 37 | | [(2) an expenditure is not required to be included in a |
|---|
| 38 | 38 | | report under Section 305.0063 for a calendar year before the year in |
|---|
| 39 | 39 | | which the amount is readily determinable by the person making the |
|---|
| 40 | 40 | | expenditure]. |
|---|
| 41 | 41 | | SECTION 4. Section 305.009, Government Code, is amended by |
|---|
| 42 | 42 | | adding Subsection (f) to read as follows: |
|---|
| 43 | 43 | | (f) Not later than the 15th day of each month, the |
|---|
| 44 | 44 | | commission shall make available on the commission's Internet |
|---|
| 45 | 45 | | website the information included in a report: |
|---|
| 46 | 46 | | (1) filed under Section 305.006; and |
|---|
| 47 | 47 | | (2) covering activities occurring in the previous |
|---|
| 48 | 48 | | month. |
|---|
| 49 | 49 | | SECTION 5. Section 305.0063, Government Code, is repealed. |
|---|
| 50 | 50 | | SECTION 6. The changes in law made by this Act apply only to |
|---|
| 51 | 51 | | a report required to be filed under Section 305.006, Government |
|---|
| 52 | 52 | | Code, on or after January 1, 2024. A report required to be filed |
|---|
| 53 | 53 | | under Section 305.006, Government Code, before January 1, 2024, is |
|---|
| 54 | 54 | | governed by the law in effect immediately before the effective date |
|---|
| 55 | 55 | | of this Act, and the former law is continued in effect for that |
|---|
| 56 | 56 | | purpose. |
|---|
| 57 | 57 | | SECTION 7. The repeal by this Act of Section 305.0063, |
|---|
| 58 | 58 | | Government Code, does not affect an election to file an activities |
|---|
| 59 | 59 | | report under that section that is made before the effective date of |
|---|
| 60 | 60 | | this Act. An election to file an activities report under former |
|---|
| 61 | 61 | | Section 305.0063, Government Code, that is made before the |
|---|
| 62 | 62 | | effective date of this Act is governed by the law in effect on the |
|---|
| 63 | 63 | | date the election was made, and the former law is continued in |
|---|
| 64 | 64 | | effect for that purpose. |
|---|
| 65 | 65 | | SECTION 8. This Act takes effect December 1, 2023. |
|---|
