55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to measures to assist students enrolled at public
88 institutions of higher education who are homeless or who are or were
99 in foster care.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 51.9356, Education Code, is amended to
1212 read as follows:
1313 Sec. 51.9356. DESIGNATION OF LIAISON OFFICER TO ASSIST
1414 STUDENTS WHO ARE OR WERE IN FOSTER CARE OR WHO ARE HOMELESS. (a) In
1515 this section:
1616 (1) "Institution[, "institution] of higher education"
1717 has the meaning assigned by Section 61.003.
1818 (2) "Students who are homeless" has the meaning
1919 assigned to the term "homeless children and youths" under 42 U.S.C.
2020 Section 11434a and includes students who reside in a student
2121 housing facility maintained by an institution of higher education
2222 during an academic term but who are homeless between academic
2323 terms.
2424 (b) Each institution of higher education shall designate at
2525 least one employee of the institution to act as a liaison officer
2626 for current and incoming:
2727 (1) students [at the institution] who are or were
2828 [formerly] in the conservatorship of the Department of Family and
2929 Protective Services; and
3030 (2) students who are homeless.
3131 (c) To the extent allowed by state or federal law, an [the]
3232 institution of higher education shall identify [those] students
3333 described by Subsection (b) from information provided to the
3434 institution in admission or financial aid applications or other
3535 available resources.
3636 (d) An institution of higher education may designate under
3737 Subsection (b) the same employee or employees to act as liaison
3838 officer for each student population described in that subsection or
3939 one or more different employees to act as liaison officer for each
4040 of those student populations separately.
4141 (e) [(c)] Each semester or other academic term, an
4242 institution of higher education shall provide to the institution's
4343 liaison officer or officers the names of and information regarding
4444 the students described by Subsection (b) for whom the officer is
4545 designated.
4646 (f) A [(d) The] liaison officer shall provide to the
4747 students described by Subsection (b) for whom the officer is
4848 designated information regarding support services including
4949 financial aid, on-campus and off-campus housing, food and meal
5050 programs, and counseling services, [and] other resources available
5151 to the students at the institution of higher education, and any
5252 other relevant information to assist the students.
5353 (g) A [(e) The] liaison officer may participate in any
5454 training that enables the officer to carry out the officer's duties
5555 and coordinate with liaison officers at other educational
5656 institutions.
5757 (h) [(f)] Each institution of higher education shall
5858 publicize, including through the institution's Internet website,
5959 social media, electronic mail, or other means of communication used
6060 by the institution:
6161 (1) the name of and contact information for the
6262 institution's liaison officer or officers; and
6363 (2) information regarding support services and other
6464 resources available at the institution to the students described by
6565 Subsection (b).
6666 SECTION 2. The heading to Section 51.978, Education Code,
6767 is amended to read as follows:
6868 Sec. 51.978. TEMPORARY HOUSING BETWEEN ACADEMIC TERMS FOR
6969 CERTAIN STUDENTS WHO WERE [FORMERLY] UNDER CONSERVATORSHIP OF
7070 DEPARTMENT OF FAMILY AND PROTECTIVE SERVICES OR WHO ARE HOMELESS.
7171 SECTION 3. Section 51.978(a), Education Code, is amended by
7272 adding Subdivision (3) to read as follows:
7373 (3) "Students who are homeless" has the meaning
7474 assigned to the term "homeless children and youths" under 42 U.S.C.
7575 Section 11434a and includes students who reside in a student
7676 housing facility maintained by an institution of higher education
7777 during an academic term but who are homeless between academic
7878 terms.
7979 SECTION 4. Section 51.978(b), Education Code, is amended to
8080 read as follows:
8181 (b) To be eligible to receive housing assistance from an
8282 institution of higher education under Subsection (c), a student
8383 must:
8484 (1) be:
8585 (A) a student who has [have] been under the
8686 conservatorship of the Department of Family and Protective Services
8787 or its predecessor in function on the day preceding:
8888 (i) [(A)] the student's 18th birthday; or
8989 (ii) [(B)] the date the student's
9090 disabilities of minority are removed by a court under Chapter 31,
9191 Family Code; or
9292 (B) a student who is homeless;
9393 (2) be enrolled full-time at the institution during
9494 the academic term immediately preceding the period for which the
9595 student requests the housing assistance;
9696 (3) be registered or otherwise have taken the actions
9797 required by the institution to permit the student to enroll
9898 full-time at the institution during the academic term immediately
9999 following the period for which the student requests the housing
100100 assistance; and
101101 (4) lack other reasonable temporary housing
102102 alternatives between the academic terms described by Subdivisions
103103 (2) and (3), as determined by the institution.
104104 SECTION 5. Subchapter Z, Chapter 51, Education Code, is
105105 amended by adding Section 51.9781 to read as follows:
106106 Sec. 51.9781. PRIORITY ACCESS TO STUDENT HOUSING FOR
107107 STUDENTS WHO ARE HOMELESS. (a) In this section:
108108 (1) "Institution of higher education" has the meaning
109109 assigned by Section 61.003.
110110 (2) "Students who are homeless" has the meaning
111111 assigned to the term "homeless children and youths" under 42 U.S.C.
112112 Section 11434a and includes students who reside in a student
113113 housing facility maintained by an institution of higher education
114114 during an academic term but who are homeless between academic
115115 terms.
116116 (b) Each institution of higher education that maintains
117117 student housing facilities shall give priority in the assignment of
118118 housing in those facilities to students who are homeless.
119119 SECTION 6. Section 61.0908, Education Code, is amended to
120120 read as follows:
121121 Sec. 61.0908. DESIGNATION OF LIAISON OFFICER TO ASSIST
122122 STUDENTS WHO WERE [FORMERLY] IN FOSTER CARE OR WHO ARE HOMELESS.
123123 (a) In this section, "students who are homeless" has the meaning
124124 assigned to the term "homeless children and youths" under 42 U.S.C.
125125 Section 11434a and includes students who reside in a student
126126 housing facility maintained by an institution of higher education
127127 during an academic term but who are homeless between academic
128128 terms.
129129 (b) The board shall designate at least one employee of the
130130 board to act as a liaison officer for the following current and
131131 incoming students at institutions of higher education:
132132 (1) students who were formerly in the conservatorship
133133 of the Department of Family and Protective Services; and
134134 (2) students who are homeless.
135135 (c) The board may designate under Subsection (b) the same
136136 employee or employees to act as liaison officer for each student
137137 population described in that subsection or one or more different
138138 employees to act as liaison officer for each of those student
139139 populations separately. A [The] liaison officer shall assist the
140140 students for whom the officer is designated in coordinating college
141141 readiness and student success efforts relating to the [those]
142142 students.
143143 SECTION 7. The changes in law made by this Act apply
144144 beginning with the 2023-2024 academic year.
145145 SECTION 8. This Act takes effect immediately if it receives
146146 a vote of two-thirds of all the members elected to each house, as
147147 provided by Section 39, Article III, Texas Constitution. If this
148148 Act does not receive the vote necessary for immediate effect, this
149149 Act takes effect September 1, 2023.
