55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the fee required for the Texas Physician Health
88 Program; reducing the amount of a fee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 153.051(d), Occupations Code, is amended
1111 to read as follows:
1212 (d) The board may not set, charge, collect, receive, or
1313 deposit any of the following fees in excess of:
1414 (1) $900 for a license;
1515 (2) $400 for a first registration permit;
1616 (3) $200 for a temporary license;
1717 (4) $400 for renewal of a registration permit;
1818 (5) $200 for a physician-in-training permit;
1919 (6) $600 for the processing of an application and the
2020 issuance of a registration for anesthesia in an outpatient setting;
2121 (7) $200 for an endorsement to other state medical
2222 boards;
2323 (8) $200 for a duplicate license;
2424 (9) $700 for a reinstated license after cancellation
2525 for cause; or
2626 (10) $5 [$1,200] for the [an annual] fee under Section
2727 167.011(c) for a program participant in the Texas Physician Health
2828 Program, due at the time of license issuance and registration
2929 permit renewal.
3030 SECTION 2. Section 167.011(c), Occupations Code, is amended
3131 to read as follows:
3232 (c) Each license holder [program participant] shall pay the
3333 [an annual] fee required under Section 153.051(d)(10) to partially
3434 offset the cost of participation and monitoring services.
3535 SECTION 3. Section 153.051, Occupations Code, as amended by
3636 this Act, applies to the initial issuance of a license or the
3737 renewal of a registration permit under Subtitle B, Title 3,
3838 Occupations Code, on or after September 1, 2023. A license
3939 initially issued or registration permit renewed before September 1,
4040 2023, is governed by the law in effect immediately before the
4141 effective date of this Act, and the former law is continued in
4242 effect for that purpose.
4343 SECTION 4. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2023.
