| 7 | 7 | | relating to the eligibility of a district judge or former district |

| 8 | 8 | | judge for burial in the State Cemetery. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 2165.256(d) and (e), Government Code, |
|---|
| 11 | 11 | | are amended to read as follows: |
|---|
| 12 | 12 | | (d) Persons eligible for burial in the State Cemetery are: |
|---|
| 13 | 13 | | (1) a former member of the legislature or a member who |
|---|
| 14 | 14 | | dies in office; |
|---|
| 15 | 15 | | (2) a former elective state official or an elective |
|---|
| 16 | 16 | | state official who dies in office; |
|---|
| 17 | 17 | | (3) a former state official or a state official who |
|---|
| 18 | 18 | | dies in office who has been appointed by the governor and confirmed |
|---|
| 19 | 19 | | by the senate and who served at least 10 years in the office to which |
|---|
| 20 | 20 | | appointed; |
|---|
| 21 | 21 | | (4) a person specified by a governor's proclamation, |
|---|
| 22 | 22 | | subject to review and approval by the committee under Subsection |
|---|
| 23 | 23 | | (e); |
|---|
| 24 | 24 | | (5) a person specified by a concurrent resolution |
|---|
| 25 | 25 | | adopted by the legislature, subject to review and approval by the |
|---|
| 26 | 26 | | committee under Subsection (e); [and] |
|---|
| 27 | 27 | | (6) a person specified by order of the committee under |
|---|
| 28 | 28 | | Subsection (e); and |
|---|
| 29 | 29 | | (7) a former district judge or a district judge who |
|---|
| 30 | 30 | | dies in office. |
|---|
| 31 | 31 | | (e) The committee shall review the names of state officials |
|---|
| 32 | 32 | | presented to the committee for consideration under Subsections |
|---|
| 33 | 33 | | [Subsection] (d)(3) and (7), in proclamations under Subsection |
|---|
| 34 | 34 | | (d)(4), and in resolutions under Subsection (d)(5). A person whose |
|---|
| 35 | 35 | | name is presented to the committee or who is specified in a |
|---|
| 36 | 36 | | proclamation or resolution is eligible for burial in the State |
|---|
| 37 | 37 | | Cemetery only if the committee, following its review, finds that |
|---|
| 38 | 38 | | the person specified made a significant contribution to Texas |
|---|
| 39 | 39 | | history and only if, based on that finding, the committee approves |
|---|
| 40 | 40 | | the person's burial in the cemetery. The committee may by order |
|---|
| 41 | 41 | | authorize a burial under Subsection (d)(6) only if the committee |
|---|
| 42 | 42 | | finds that the person made a significant contribution to Texas |
|---|
| 43 | 43 | | history, which may include a person who served this state through |
|---|
| 44 | 44 | | public administration or governmental service. |
|---|
| 45 | 45 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 46 | 46 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 47 | 47 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 48 | 48 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 49 | 49 | | Act takes effect September 1, 2023. |
