66 AN ACT
77 relating to the eligibility of a district judge or former district
88 judge for burial in the State Cemetery.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 2165.256(d) and (e), Government Code,
1111 are amended to read as follows:
1212 (d) Persons eligible for burial in the State Cemetery are:
1313 (1) a former member of the legislature or a member who
1414 dies in office;
1515 (2) a former elective state official or an elective
1616 state official who dies in office;
1717 (3) a former state official or a state official who
1818 dies in office who has been appointed by the governor and confirmed
1919 by the senate and who served at least 10 years in the office to which
2020 appointed;
2121 (4) a person specified by a governor's proclamation,
2222 subject to review and approval by the committee under Subsection
2323 (e);
2424 (5) a person specified by a concurrent resolution
2525 adopted by the legislature, subject to review and approval by the
2626 committee under Subsection (e); [and]
2727 (6) a person specified by order of the committee under
2828 Subsection (e); and
2929 (7) a former district judge or a district judge who
3030 dies in office.
3131 (e) The committee shall review the names of state officials
3232 presented to the committee for consideration under Subsections
3333 [Subsection] (d)(3) and (7), in proclamations under Subsection
3434 (d)(4), and in resolutions under Subsection (d)(5). A person whose
3535 name is presented to the committee or who is specified in a
3636 proclamation or resolution is eligible for burial in the State
3737 Cemetery only if the committee, following its review, finds that
3838 the person specified made a significant contribution to Texas
3939 history and only if, based on that finding, the committee approves
4040 the person's burial in the cemetery. The committee may by order
4141 authorize a burial under Subsection (d)(6) only if the committee
4242 finds that the person made a significant contribution to Texas
4343 history, which may include a person who served this state through
4444 public administration or governmental service.
4545 SECTION 2. This Act takes effect immediately if it receives
4646 a vote of two-thirds of all the members elected to each house, as
4747 provided by Section 39, Article III, Texas Constitution. If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2023.
