66 relating to the administration of the Texas Physician Health
77 Program; authorizing a surcharge.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 153.051(d), Occupations Code, is amended
1010 to read as follows:
1111 (d) The board may not set, charge, collect, receive, or
1212 deposit any of the following fees in excess of:
1313 (1) $900 for a license;
1414 (2) $400 for a first registration permit;
1515 (3) $200 for a temporary license;
1616 (4) $400 for renewal of a registration permit;
1717 (5) $200 for a physician-in-training permit;
1818 (6) $600 for the processing of an application and the
1919 issuance of a registration for anesthesia in an outpatient setting;
2020 (7) $200 for an endorsement to other state medical
2121 boards;
2222 (8) $200 for a duplicate license;
2323 (9) $700 for a reinstated license after cancellation
2424 for cause; or
2525 (10) $15 [$1,200] for a surcharge [an annual fee]
2626 under Section 153.053 to administer [167.011(c) for a program
2727 participant in] the Texas Physician Health Program, due at the time
2828 of license issuance and registration permit renewal.
2929 SECTION 2. Subchapter B, Chapter 153, Occupations Code, is
3030 amended by adding Section 153.053 to read as follows:
3131 Sec. 153.053. SURCHARGE TO ADMINISTER TEXAS PHYSICIAN
3232 HEALTH PROGRAM. (a) The board shall collect an additional
3333 surcharge not to exceed $15 for each of the following fees:
3434 (1) first registration permit; and
3535 (2) renewal of a registration permit.
3636 (b) The board shall deposit each surcharge collected under
3737 this section to the credit of the Texas physician health program
3838 account. The Texas physician health program account is a special
3939 account in the general revenue fund. Money in the special account
4040 shall be appropriated only to the board to pay for administration of
4141 the Texas Physician Health Program under Chapter 167, including
4242 paying for an initial evaluation by the program's medical director
4343 or the director's designee. Money in the special account may not be
4444 used to pay for program participant costs incurred for monitoring
4545 or for a program participant's own medical costs, including any
4646 further required evaluations, primary treatment, or continuing
4747 care.
4848 SECTION 3. Section 167.011, Occupations Code, is repealed.
4949 SECTION 4. Section 153.051, Occupations Code, as amended by
5050 this Act, and Section 153.053, Occupations Code, as added by this
5151 Act, apply to the initial issuance of a license or the renewal of a
5252 registration permit under Subtitle B, Title 3, Occupations Code, on
5353 or after September 1, 2023. A license initially issued or
5454 registration permit renewed before September 1, 2023, is governed
5555 by the law in effect immediately before the effective date of this
5656 Act, and the former law is continued in effect for that purpose.
5757 SECTION 5. This Act takes effect September 1, 2023.
