| 7 | 7 | | Program; authorizing a surcharge. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 153.051(d), Occupations Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (d) The board may not set, charge, collect, receive, or |
|---|
| 12 | 12 | | deposit any of the following fees in excess of: |
|---|
| 13 | 13 | | (1) $900 for a license; |
|---|
| 14 | 14 | | (2) $400 for a first registration permit; |
|---|
| 15 | 15 | | (3) $200 for a temporary license; |
|---|
| 16 | 16 | | (4) $400 for renewal of a registration permit; |
|---|
| 17 | 17 | | (5) $200 for a physician-in-training permit; |
|---|
| 18 | 18 | | (6) $600 for the processing of an application and the |
|---|
| 19 | 19 | | issuance of a registration for anesthesia in an outpatient setting; |
|---|
| 20 | 20 | | (7) $200 for an endorsement to other state medical |
|---|
| 21 | 21 | | boards; |
|---|
| 22 | 22 | | (8) $200 for a duplicate license; |
|---|
| 23 | 23 | | (9) $700 for a reinstated license after cancellation |
|---|
| 24 | 24 | | for cause; or |
|---|
| 25 | 25 | | (10) $15 [$1,200] for a surcharge [an annual fee] |
|---|
| 26 | 26 | | under Section 153.053 to administer [167.011(c) for a program |
|---|
| 27 | 27 | | participant in] the Texas Physician Health Program, due at the time |
|---|
| 28 | 28 | | of license issuance and registration permit renewal. |

| 29 | 29 | | SECTION 2. Subchapter B, Chapter 153, Occupations Code, is |
|---|
| 30 | 30 | | amended by adding Section 153.053 to read as follows: |
|---|
| 31 | 31 | | Sec. 153.053. SURCHARGE TO ADMINISTER TEXAS PHYSICIAN |
|---|
| 32 | 32 | | HEALTH PROGRAM. (a) The board shall collect an additional |
|---|
| 33 | 33 | | surcharge not to exceed $15 for each of the following fees: |
|---|
| 34 | 34 | | (1) first registration permit; and |
|---|
| 35 | 35 | | (2) renewal of a registration permit. |
|---|
| 36 | 36 | | (b) The board shall deposit each surcharge collected under |
|---|
| 37 | 37 | | this section to the credit of the Texas physician health program |
|---|
| 38 | 38 | | account. The Texas physician health program account is a special |
|---|
| 39 | 39 | | account in the general revenue fund. Money in the special account |
|---|
| 40 | 40 | | shall be appropriated only to the board to pay for administration of |
|---|
| 41 | 41 | | the Texas Physician Health Program under Chapter 167, including |
|---|
| 42 | 42 | | paying for an initial evaluation by the program's medical director |
|---|
| 43 | 43 | | or the director's designee. Money in the special account may not be |
|---|
| 44 | 44 | | used to pay for program participant costs incurred for monitoring |
|---|
| 45 | 45 | | or for a program participant's own medical costs, including any |
|---|
| 46 | 46 | | further required evaluations, primary treatment, or continuing |
|---|
| 47 | 47 | | care. |
|---|
| 48 | 48 | | SECTION 3. Section 167.011, Occupations Code, is repealed. |
|---|
| 49 | 49 | | SECTION 4. Section 153.051, Occupations Code, as amended by |
|---|
| 50 | 50 | | this Act, and Section 153.053, Occupations Code, as added by this |
|---|
| 51 | 51 | | Act, apply to the initial issuance of a license or the renewal of a |
|---|
| 52 | 52 | | registration permit under Subtitle B, Title 3, Occupations Code, on |
|---|
| 53 | 53 | | or after September 1, 2023. A license initially issued or |
|---|
| 54 | 54 | | registration permit renewed before September 1, 2023, is governed |
|---|
| 55 | 55 | | by the law in effect immediately before the effective date of this |
|---|
| 56 | 56 | | Act, and the former law is continued in effect for that purpose. |
|---|
| 57 | 57 | | SECTION 5. This Act takes effect September 1, 2023. |
