55 relating to facilities included in the electricity supply chain.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Section 37.157, Utilities Code, is amended to
88 read as follows:
99 Sec. 37.157. MAPS. (a) An electric utility shall file
1010 with the commission one or more maps that show each utility facility
1111 and that separately illustrate each utility facility for the
1212 generation, transmission, or distribution of the utility's
1313 services on a date the commission orders.
1414 (b) Each electric utility, transmission and distribution
1515 utility, electric cooperative, and municipally owned utility shall
1616 provide the utility's service area boundary map, using good faith
1717 efforts, in a geographic information system format to the
1818 commission. The service area boundary map may be provided to the
1919 commission in a geodatabase feature class or shapefile.
2020 SECTION 2. Section 38.201, Utilities Code, is amended by
2121 amending Subsections (a), (b), and (c) and adding Subsection (a-1)
2222 to read as follows:
2323 (a) In this subchapter, "electricity supply chain" means:
2424 (1) facilities and methods used for producing,
2525 treating, processing, pressurizing, storing, or transporting
2626 natural gas for delivery to electric generation facilities; [and]
2727 (2) critical infrastructure necessary to maintain
2828 electricity service; and
2929 (3) roads necessary to access facilities in the
3030 electricity supply chain.
3131 (a-1) A reference in this subchapter to the "electricity
3232 supply chain" includes water and wastewater treatment plants.
3333 (b) The Texas Electricity Supply Chain Security and Mapping
3434 Committee is established to:
3535 (1) map this state's electricity supply chain;
3636 (2) identify critical infrastructure sources in the
3737 electricity supply chain;
3838 (3) establish best practices to prepare facilities
3939 [that provide electric service and natural gas service] in the
4040 electricity supply chain to maintain service in an extreme weather
4141 event and recommend oversight and compliance standards for those
4242 facilities; and
4343 (4) designate priority service needs to prepare for,
4444 respond to, and recover from an extreme weather event.
4545 (c) The committee is composed of:
4646 (1) the executive director of the commission;
4747 (2) the executive director of the Railroad Commission
4848 of Texas;
4949 (3) the president and the chief executive officer of
5050 the independent organization certified under Section 39.151 for the
5151 ERCOT power region; [and]
5252 (4) the chief of the Texas Division of Emergency
5353 Management; and
5454 (5) the executive director of the Texas Department of
5555 Transportation.
5656 SECTION 3. Section 38.202(c), Utilities Code, is amended to
5757 read as follows:
5858 (c) The commission, the Railroad Commission of Texas, [and]
5959 the Texas Division of Emergency Management, and the Texas
6060 Department of Transportation shall provide staff as necessary to
6161 assist the committee in carrying out the committee's duties and
6262 responsibilities.
6363 SECTION 4. Section 38.203, Utilities Code, is amended by
6464 amending Subsection (a) and adding Subsections (f), (g), (h), and
6565 (i) to read as follows:
6666 (a) The committee shall:
6767 (1) map the state's electricity supply chain in order
6868 to designate priority electricity service needs during extreme
6969 weather events;
7070 (2) identify and designate the sources in the
7171 electricity supply chain necessary to operate critical
7272 infrastructure, as defined by Section 421.001, Government Code;
7373 (3) develop a communication system between critical
7474 infrastructure sources, the commission, and the independent
7575 organization certified under Section 39.151 for the ERCOT power
7676 region to ensure that electricity and natural gas supplies in the
7777 electricity supply chain are prioritized to those sources during an
7878 extreme weather event; and
7979 (4) establish best practices to prepare facilities
8080 [that provide electric service and natural gas service] in the
8181 electricity supply chain to maintain service in an extreme weather
8282 event and recommend oversight and compliance standards for those
8383 facilities.
8484 (f) On request, the committee shall provide view-only
8585 access to the electricity supply chain map to:
8686 (1) an electric utility, a transmission and
8787 distribution utility, an electric cooperative, or a municipally
8888 owned utility;
8989 (2) an operator of a gas supply chain facility, as
9090 defined by Section 86.044, Natural Resources Code; or
9191 (3) an operator of a gas pipeline facility described
9292 by Section 121.2015.
9393 (g) Access to the electricity supply chain map by an entity
9494 described by Subsection (f)(1) is limited to the critical natural
9595 gas facilities on the map that are located in the requesting
9696 entity's service area.
9797 (h) The committee may not provide an entity described by
9898 Subsection (f)(1) with access to the electricity supply chain map
9999 unless the entity has complied with Section 37.157.
100100 (i) Access to the electricity supply chain map by an
101101 operator described by Subsections (f)(2) and (3) is limited to the
102102 critical natural gas facilities operated by the requesting
103103 operator.
104104 SECTION 5. The Public Utility Commission of Texas shall
105105 require each entity to which Section 37.157(b), Utilities Code, as
106106 added by this Act, applies to comply with that section not later
107107 than September 30, 2023.
108108 SECTION 6. This Act takes effect immediately if it receives
109109 a vote of two-thirds of all the members elected to each house, as
110110 provided by Section 39, Article III, Texas Constitution. If this
111111 Act does not receive the vote necessary for immediate effect, this
112112 Act takes effect September 1, 2023.
