55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to excused absences from public school for certain
88 students to attend mental health care appointments.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 25.087(b), Education Code, is amended to
1111 read as follows:
1212 (b) A school district shall excuse a student from attending
1313 school for:
1414 (1) the following purposes, including travel for those
1515 purposes:
1616 (A) observing religious holy days;
1717 (B) attending a required court appearance;
1818 (C) appearing at a governmental office to
1919 complete paperwork required in connection with the student's
2020 application for United States citizenship;
2121 (D) taking part in a United States naturalization
2222 oath ceremony;
2323 (E) serving as an election clerk; or
2424 (F) if the student is in the conservatorship of
2525 the Department of Family and Protective Services, participating, as
2626 determined and documented by the department, in an activity:
2727 (i) ordered by a court under Chapter 262 or
2828 263, Family Code, provided that it is not practicable to schedule
2929 the participation outside of school hours; or
3030 (ii) required under a service plan under
3131 Subchapter B, Chapter 263, Family Code;
3232 (2) a temporary absence resulting from an appointment
3333 with health care professionals, including mental health
3434 professionals, for the student or the student's child if the
3535 student commences classes or returns to school on the same day of
3636 the appointment; or
3737 (3) an absence resulting from a serious or
3838 life-threatening illness or related treatment that makes the
3939 student's attendance infeasible, if the student or the student's
4040 parent or guardian provides a certification from a physician
4141 licensed to practice medicine in this state specifying the
4242 student's illness and the anticipated period of the student's
4343 absence relating to the illness or related treatment.
4444 SECTION 2. This Act applies beginning with the 2023-2024
4545 school year.
4646 SECTION 3. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect September 1, 2023.
