55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the repeal of statutes regarding the criminality or
88 unacceptability of homosexual conduct and to the recognition of
99 certain same-sex relationship statuses.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The following laws are repealed:
1212 (1) Sections 2.001(b), 3.401(5), and 6.204, Family
1313 Code;
1414 (2) Sections 810.001(g), (h), and (i), Government
1515 Code; and
1616 (3) Section 21.06, Penal Code.
1717 SECTION 2. Section 85.007(b), Health and Safety Code, is
1818 amended to read as follows:
1919 (b) The materials in the education programs intended for
2020 persons younger than 18 years of age must[:
2121 [(1)] emphasize sexual abstinence before marriage and
2222 fidelity in marriage as the expected standard in terms of public
2323 health and the most effective ways to prevent HIV infection,
2424 sexually transmitted diseases, and unwanted pregnancies[; and
2525 [(2) state that homosexual conduct is not an
2626 acceptable lifestyle and is a criminal offense under Section 21.06,
2727 Penal Code].
2828 SECTION 3. Section 163.002, Health and Safety Code, is
2929 amended to read as follows:
3030 Sec. 163.002. INSTRUCTIONAL ELEMENTS. Course materials and
3131 instruction relating to sexual education or sexually transmitted
3232 diseases should include:
3333 (1) an emphasis on sexual abstinence as the only
3434 completely reliable method of avoiding unwanted teenage pregnancy
3535 and sexually transmitted diseases;
3636 (2) an emphasis on the importance of self-control,
3737 responsibility, and ethical conduct in making decisions relating to
3838 sexual behavior;
3939 (3) statistics, based on the latest medical
4040 information, that indicate the efficacy of the various forms of
4141 contraception;
4242 (4) information concerning the laws relating to the
4343 financial responsibilities associated with pregnancy, childbirth,
4444 and child rearing;
4545 (5) information concerning the laws prohibiting
4646 sexual abuse and the legal and counseling options available to
4747 victims of sexual abuse;
4848 (6) information on how to cope with and rebuff
4949 unwanted physical and verbal sexual advances, as well as the
5050 importance of avoiding the sexual exploitation of other persons;
5151 and
5252 (7) psychologically sound methods of resisting
5353 unwanted peer pressure[; and
5454 [(8) emphasis, provided in a factual manner and from a
5555 public health perspective, that homosexuality is not a lifestyle
5656 acceptable to the general public and that homosexual conduct is a
5757 criminal offense under Section 21.06, Penal Code].
5858 SECTION 4. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2023.
