66 Public Utility Commission of Texas.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter F, Chapter 411, Government Code, is
99 amended by adding Section 411.14031 to read as follows:
1010 Sec. 411.14031. ACCESS TO CRIMINAL HISTORY RECORD
1111 INFORMATION: PUBLIC UTILITY COMMISSION OF TEXAS. (a) The Public
1212 Utility Commission of Texas is entitled to obtain from the
1313 department criminal history record information maintained by the
1414 department that relates to a person undergoing a background and
1515 criminal history check under Section 12.107, Utilities Code.
1616 (b) Criminal history record information obtained under
1717 Subsection (a):
1818 (1) is for the exclusive use of the Public Utility
1919 Commission of Texas and is privileged and confidential; and
2020 (2) may not be released or disclosed to any person or
2121 agency except on court order or with the consent of the person who
2222 is the subject of the information.
2323 (c) The Public Utility Commission of Texas may destroy
2424 criminal history record information obtained under Subsection (a)
2525 after the information is used for the purpose authorized by this
2626 section.
2727 (d) This section does not prohibit the Public Utility
2828 Commission of Texas from obtaining and using criminal history
2929 record information as provided by other law.
3030 SECTION 2. Subchapter C, Chapter 12, Utilities Code, is
3131 amended by adding Section 12.107 to read as follows:
3232 Sec. 12.107. CRIMINAL HISTORY CHECKS FOR CERTAIN EMPLOYEES.
3333 Before hiring a person as an employee, the commission may obtain
3434 from the Department of Public Safety or a private vendor all
3535 criminal history record information relating to the prospective
3636 employee.
3737 SECTION 3. This Act takes effect September 1, 2023.
