| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter F, Chapter 411, Government Code, is |
|---|
| 9 | 9 | | amended by adding Section 411.14031 to read as follows: |
|---|
| 10 | 10 | | Sec. 411.14031. ACCESS TO CRIMINAL HISTORY RECORD |
|---|
| 11 | 11 | | INFORMATION: PUBLIC UTILITY COMMISSION OF TEXAS. (a) The Public |
|---|
| 12 | 12 | | Utility Commission of Texas is entitled to obtain from the |
|---|
| 13 | 13 | | department criminal history record information maintained by the |
|---|
| 14 | 14 | | department that relates to a person undergoing a background and |
|---|
| 15 | 15 | | criminal history check under Section 12.107, Utilities Code. |
|---|
| 16 | 16 | | (b) Criminal history record information obtained under |
|---|
| 17 | 17 | | Subsection (a): |
|---|
| 18 | 18 | | (1) is for the exclusive use of the Public Utility |
|---|
| 19 | 19 | | Commission of Texas and is privileged and confidential; and |
|---|
| 20 | 20 | | (2) may not be released or disclosed to any person or |
|---|
| 21 | 21 | | agency except on court order or with the consent of the person who |
|---|
| 22 | 22 | | is the subject of the information. |
|---|
| 23 | 23 | | (c) The Public Utility Commission of Texas may destroy |
|---|
| 24 | 24 | | criminal history record information obtained under Subsection (a) |
|---|
| 25 | 25 | | after the information is used for the purpose authorized by this |
|---|
| 26 | 26 | | section. |
|---|
| 27 | 27 | | (d) This section does not prohibit the Public Utility |
|---|
| 28 | 28 | | Commission of Texas from obtaining and using criminal history |
|---|
| 29 | 29 | | record information as provided by other law. |
|---|
| 30 | 30 | | SECTION 2. Subchapter C, Chapter 12, Utilities Code, is |
|---|
| 31 | 31 | | amended by adding Section 12.107 to read as follows: |
|---|
| 32 | 32 | | Sec. 12.107. CRIMINAL HISTORY CHECKS FOR CERTAIN EMPLOYEES. |
|---|
| 33 | 33 | | Before hiring a person as an employee, the commission may obtain |
|---|
| 34 | 34 | | from the Department of Public Safety or a private vendor all |
|---|
| 35 | 35 | | criminal history record information relating to the prospective |
|---|
| 36 | 36 | | employee. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2023. |
