55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to entities that provide video services.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 66.002(2) and (10), Utilities Code, are
1010 amended to read as follows:
1111 (2) "Cable service" is defined as set forth in 47
1212 U.S.C. Section 522(6). The term does not include any video
1313 programming accessed via a service that enables users to access
1414 content, information, e-mail, or other services offered over the
1515 Internet, including streaming content.
1616 (10) "Video service" means video programming services
1717 provided through wireline facilities located at least in part in
1818 the public right-of-way without regard to delivery technology,
1919 including Internet protocol technology. The term [This definition]
2020 does not include:
2121 (A) any video service provided by a commercial
2222 mobile service provider as defined in 47 U.S.C. Section 332(d);
2323 (B) direct-to-home satellite services, as
2424 defined in 47 U.S.C. Section 303(v), that are transmitted from a
2525 satellite directly to a customer's premises without using or
2626 accessing a portion of the public right-of-way; or
2727 (C) any video programming accessed via a service
2828 that enables users to access content, information, e-mail, or other
2929 services offered over the Internet, including streaming content.
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2023.
