66 AN ACT
77 relating to studies of buildings and facilities owned, leased, or
88 otherwise occupied by this state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 2165, Government Code, is amended by
1111 adding Subchapter C-1 to read as follows:
1212 SUBCHAPTER C-1. STUDY OF SPACE BY LEGISLATIVE BUDGET BOARD
1313 Sec. 2165.121. DEFINITION. In this subchapter, "state
1414 agency" includes a legislative agency.
1515 Sec. 2165.122. STUDY. Not later than September 1, 2024, and
1616 the September 1 occurring every six years after that date, the
1717 Legislative Budget Board shall study and report to the legislature:
1818 (1) how much money the state is spending on leased
1919 space for state agencies;
2020 (2) the possibilities of moving personnel out of
2121 leased space into existing state-owned space;
2222 (3) any efficiencies or cost savings that may be
2323 achieved by consolidating personnel and resources into existing
2424 state-owned space;
2525 (4) any efficiencies or cost savings that may be
2626 achieved by consolidating personnel and resources into existing
2727 leased space, if no state-owned space is available;
2828 (5) the impact of any consolidation described by
2929 Subdivisions (3) and (4) on the state's insurable assets; and
3030 (6) the potential benefits of maintaining a
3131 comprehensive, regularly updated database of all buildings and
3232 facilities owned, leased, or otherwise occupied by the state.
3333 Sec. 2165.123. IDENTIFICATION OF CONSOLIDATION
3434 OPPORTUNITIES. Based on a report required by Section 2165.122,
3535 each state agency shall identify opportunities for the
3636 consolidation of personnel and resources into space owned by this
3737 state, or if state-owned space is not available, into space leased
3838 by this state.
3939 SECTION 2. (a) In this section, "institution of higher
4040 education" has the meaning assigned by Section 61.003, Education
4141 Code.
4242 (b) The Legislative Budget Board shall conduct an interim
4343 study on the buildings and facilities owned, leased, or otherwise
4444 occupied by this state and develop a statewide strategy to ensure
4545 that the buildings and facilities are adequately utilized. The
4646 Legislative Budget Board may delegate any authority granted to the
4747 board under this section that the board determines necessary to
4848 conduct the interim study under this section.
4949 (c) The Legislative Budget Board shall collect the
5050 information required by this section from each state agency and
5151 institution of higher education that has charge and control of a
5252 building or facility and require each agency and institution to
5353 submit the information to the board by a date prescribed by the
5454 board. The board shall coordinate with the following entities to
5555 collect the information:
5656 (1) the comptroller of public accounts;
5757 (2) the state auditor's office;
5858 (3) the State Office of Risk Management;
5959 (4) the General Land Office;
6060 (5) the Texas Facilities Commission;
6161 (6) the Texas Higher Education Coordinating Board; and
6262 (7) any other state agency.
6363 (d) For each building or facility owned, leased, or
6464 otherwise occupied, solely or in part, by a state agency other than
6565 an institution of higher education, the Legislative Budget Board or
6666 a state agency designated by the board shall obtain the following
6767 information:
6868 (1) the name of the state agency that has charge and
6969 control of the building or facility;
7070 (2) whether the building or facility is owned or
7171 leased, solely or in part, by the state agency, or if not owned or
7272 leased, the arrangement under which the building or facility is
7373 otherwise occupied;
7474 (3) the name or number of the building or facility;
7575 (4) the address and geographic coordinates of the
7676 building or facility;
7777 (5) the number of stories and the total square footage
7878 of the building or facility;
7979 (6) the amount of available square footage in the
8080 building or facility for working personnel, the storage of
8181 resources, or any other useable purpose identified by the agency;
8282 (7) the amount of square footage used in the building
8383 or facility for a purpose described by Subdivision (6) of this
8484 subsection, expressed as a percent of the total square footage;
8585 (8) if the building or facility changed occupants on
8686 or after December 31, 2019:
8787 (A) with respect to a new occupant:
8888 (i) the location formerly occupied;
8989 (ii) the amount of square footage used at
9090 the formerly occupied location; and
9191 (iii) the amount of square footage used at
9292 the building or facility; and
9393 (B) with respect to a former occupant:
9494 (i) the location to which the former
9595 occupant moved;
9696 (ii) the amount of square footage formerly
9797 used at the building or facility; and
9898 (iii) the amount of square footage used at
9999 the newly occupied location;
100100 (9) a description of the continuity of government
101101 operation plans to conduct business in alternate sites in the event
102102 of a disaster or other emergency; and
103103 (10) the average monthly utility expenses for the
104104 building or facility during the previous 12 months.
105105 (e) The Legislative Budget Board or a state agency
106106 designated by the board shall collect the real property data of an
107107 institution of higher education from the Texas Higher Education
108108 Coordinating Board, as the data is reported to that board,
109109 including, for each building or facility owned, leased, or
110110 otherwise occupied by the institution:
111111 (1) the name of the institution that has charge and
112112 control of the building or facility, including the number assigned
113113 to the institution by the Federal Interagency Committee on
114114 Education;
115115 (2) whether the building or facility is owned or
116116 leased, solely or in part, by the institution, or if not owned or
117117 leased, the arrangement under which the building or facility is
118118 otherwise occupied;
119119 (3) the name or number of the building or facility;
120120 (4) the address and geographic coordinates of the
121121 building or facility;
122122 (5) the number of stories and the total square footage
123123 of the building or facility;
124124 (6) the amount of available square footage in the
125125 building or facility for working personnel, the storage of
126126 resources, or any other useable purpose identified by the
127127 institution;
128128 (7) the amount of square footage used in the building
129129 or facility for a purpose described by Subdivision (6) of this
130130 subsection, expressed as a percent of the total square footage;
131131 (8) if the building or facility changed occupants on
132132 or after December 31, 2019:
133133 (A) with respect to a new occupant:
134134 (i) the location formerly occupied;
135135 (ii) the amount of square footage used at
136136 the formerly occupied location; and
137137 (iii) the amount of square footage used at
138138 the building or facility; and
139139 (B) with respect to a former occupant:
140140 (i) the location to which the former
141141 occupant moved;
142142 (ii) the amount of square footage formerly
143143 used at the building or facility; and
144144 (iii) the amount of square footage used at
145145 the newly occupied location;
146146 (9) a description of the continuity of government
147147 operation plans to conduct business in alternate sites in the event
148148 of a disaster or other emergency; and
149149 (10) the average monthly utility expenses for the
150150 building or facility during the previous 12 months.
151151 (f) On request by the Legislative Budget Board, the Texas
152152 Facilities Commission shall provide clarifying information under
153153 Subsections (d) and (e) of this section, including information on
154154 buildings that house multiple state agencies and other related
155155 matters. The Texas Facilities Commission shall provide the
156156 information to the Legislative Budget Board by the date prescribed
157157 by the board.
158158 (g) On request by the Texas Facilities Commission or the
159159 State Office of Risk Management, a state agency shall provide the
160160 agency's telework policies to the entity requesting the
161161 information. The Texas Facilities Commission and the State Office
162162 of Risk Management shall coordinate to reduce duplication of
163163 efforts.
164164 (h) Not later than June 1, 2024, the Legislative Budget
165165 Board or a state agency designated by the board shall consolidate
166166 the information collected under Subsections (d), (e), and (f) of
167167 this section and enter the information into a single database
168168 accessible by a member of the legislature or the member's designee
169169 or the executive head of a state agency or institution of higher
170170 education or the executive head's designee.
171171 (i) The Legislative Budget Board shall conduct the study
172172 required by Subsection (b) of this section and report the board's
173173 findings and recommendations to the legislature not later than
174174 September 1, 2024. The report must include a statewide strategy
175175 that will ensure all property owned, leased, or otherwise occupied
176176 by the state is adequately utilized.
177177 (j) The Legislative Budget Board, State Office of Risk
178178 Management, and Texas Facilities Commission shall produce maps
179179 identifying the locations of the buildings and facilities owned,
180180 leased, or otherwise occupied by state agencies and institutions of
181181 higher education across this state.
182182 (k) The information collected and produced under this
183183 section is excepted from disclosure under Sections 552.021 and
184184 552.156, Government Code, and Sections 412.0128 and 412.054, Labor
185185 Code.
186186 (l) The Legislative Budget Board may consolidate the study
187187 and report required by this section with any report required of the
188188 board by law regarding the allocation and use of space by state
189189 agencies.
190190 (m) Based on the report required by this section, each
191191 state agency shall identify opportunities for the consolidation of
192192 personnel and resources into space owned by this state, or if
193193 state-owned space is not available, into space leased by this
194194 state.
195195 (n) This section expires September 1, 2025.
196196 SECTION 3. Based on information collected and published by
197197 the Legislative Budget Board as described by this Act or any
198198 findings or recommendations by an entity conducting a study under
199199 this Act, each state agency shall identify opportunities for the
200200 consolidation of personnel and resources into space owned by this
201201 state, or if state-owned space is not available, into space leased
202202 by this state.
203203 SECTION 4. This Act takes effect immediately if it receives
204204 a vote of two-thirds of all the members elected to each house, as
205205 provided by Section 39, Article III, Texas Constitution. If this
206206 Act does not receive the vote necessary for immediate effect, this
207207 Act takes effect September 1, 2023.
