7	7	relating to studies of buildings and facilities owned, leased, or
8	8	otherwise occupied by this state.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Chapter 2165, Government Code, is amended by
11	11	adding Subchapter C-1 to read as follows:
12	12	SUBCHAPTER C-1. STUDY OF SPACE BY LEGISLATIVE BUDGET BOARD
13	13	Sec. 2165.121. DEFINITION. In this subchapter, "state
14	14	agency" includes a legislative agency.
15	15	Sec. 2165.122. STUDY. Not later than September 1, 2024, and
16	16	the September 1 occurring every six years after that date, the
17	17	Legislative Budget Board shall study and report to the legislature:
18	18	(1) how much money the state is spending on leased
19	19	space for state agencies;
20	20	(2) the possibilities of moving personnel out of
21	21	leased space into existing state-owned space;
22	22	(3) any efficiencies or cost savings that may be
23	23	achieved by consolidating personnel and resources into existing
24	24	state-owned space;
25	25	(4) any efficiencies or cost savings that may be
26	26	achieved by consolidating personnel and resources into existing
27	27	leased space, if no state-owned space is available;
28	28	(5) the impact of any consolidation described by
29	29	Subdivisions (3) and (4) on the state's insurable assets; and
30	30	(6) the potential benefits of maintaining a
31	31	comprehensive, regularly updated database of all buildings and
32	32	facilities owned, leased, or otherwise occupied by the state.
33	33	Sec. 2165.123. IDENTIFICATION OF CONSOLIDATION
34	34	OPPORTUNITIES. Based on a report required by Section 2165.122,
35	35	each state agency shall identify opportunities for the
36	36	consolidation of personnel and resources into space owned by this
37	37	state, or if state-owned space is not available, into space leased
38	38	by this state.
39	39	SECTION 2. (a) In this section, "institution of higher
40	40	education" has the meaning assigned by Section 61.003, Education
41	41	Code.
42	42	(b) The Legislative Budget Board shall conduct an interim
43	43	study on the buildings and facilities owned, leased, or otherwise
44	44	occupied by this state and develop a statewide strategy to ensure
45	45	that the buildings and facilities are adequately utilized. The
46	46	Legislative Budget Board may delegate any authority granted to the
47	47	board under this section that the board determines necessary to
48	48	conduct the interim study under this section.
49	49	(c) The Legislative Budget Board shall collect the
50	50	information required by this section from each state agency and
51	51	institution of higher education that has charge and control of a
52	52	building or facility and require each agency and institution to
53	53	submit the information to the board by a date prescribed by the
54	54	board. The board shall coordinate with the following entities to
55	55	collect the information:
56	56	(1) the comptroller of public accounts;
57	57	(2) the state auditor's office;
58	58	(3) the State Office of Risk Management;
59	59	(4) the General Land Office;
60	60	(5) the Texas Facilities Commission;
61	61	(6) the Texas Higher Education Coordinating Board; and
62	62	(7) any other state agency.
63	63	(d) For each building or facility owned, leased, or
64	64	otherwise occupied, solely or in part, by a state agency other than
65	65	an institution of higher education, the Legislative Budget Board or
66	66	a state agency designated by the board shall obtain the following
67	67	information:
68	68	(1) the name of the state agency that has charge and
69	69	control of the building or facility;
70	70	(2) whether the building or facility is owned or
71	71	leased, solely or in part, by the state agency, or if not owned or
72	72	leased, the arrangement under which the building or facility is
73	73	otherwise occupied;
74	74	(3) the name or number of the building or facility;
75	75	(4) the address and geographic coordinates of the
76	76	building or facility;
77	77	(5) the number of stories and the total square footage
78	78	of the building or facility;
79	79	(6) the amount of available square footage in the
80	80	building or facility for working personnel, the storage of
81	81	resources, or any other useable purpose identified by the agency;
82	82	(7) the amount of square footage used in the building
83	83	or facility for a purpose described by Subdivision (6) of this
84	84	subsection, expressed as a percent of the total square footage;
85	85	(8) if the building or facility changed occupants on
86	86	or after December 31, 2019:
87	87	(A) with respect to a new occupant:
88	88	(i) the location formerly occupied;
89	89	(ii) the amount of square footage used at
90	90	the formerly occupied location; and
91	91	(iii) the amount of square footage used at
92	92	the building or facility; and
93	93	(B) with respect to a former occupant:
94	94	(i) the location to which the former
95	95	occupant moved;
96	96	(ii) the amount of square footage formerly
97	97	used at the building or facility; and
98	98	(iii) the amount of square footage used at
99	99	the newly occupied location;
100	100	(9) a description of the continuity of government
101	101	operation plans to conduct business in alternate sites in the event
102	102	of a disaster or other emergency; and
103	103	(10) the average monthly utility expenses for the
104	104	building or facility during the previous 12 months.
105	105	(e) The Legislative Budget Board or a state agency
106	106	designated by the board shall collect the real property data of an
107	107	institution of higher education from the Texas Higher Education
108	108	Coordinating Board, as the data is reported to that board,
109	109	including, for each building or facility owned, leased, or
110	110	otherwise occupied by the institution:
111	111	(1) the name of the institution that has charge and
112	112	control of the building or facility, including the number assigned
113	113	to the institution by the Federal Interagency Committee on
114	114	Education;
115	115	(2) whether the building or facility is owned or
116	116	leased, solely or in part, by the institution, or if not owned or
117	117	leased, the arrangement under which the building or facility is
118	118	otherwise occupied;
119	119	(3) the name or number of the building or facility;
120	120	(4) the address and geographic coordinates of the
121	121	building or facility;
122	122	(5) the number of stories and the total square footage
123	123	of the building or facility;
124	124	(6) the amount of available square footage in the
125	125	building or facility for working personnel, the storage of
126	126	resources, or any other useable purpose identified by the
127	127	institution;
128	128	(7) the amount of square footage used in the building
129	129	or facility for a purpose described by Subdivision (6) of this
130	130	subsection, expressed as a percent of the total square footage;
131	131	(8) if the building or facility changed occupants on
132	132	or after December 31, 2019:
133	133	(A) with respect to a new occupant:
134	134	(i) the location formerly occupied;
135	135	(ii) the amount of square footage used at
136	136	the formerly occupied location; and
137	137	(iii) the amount of square footage used at
138	138	the building or facility; and
139	139	(B) with respect to a former occupant:
140	140	(i) the location to which the former
141	141	occupant moved;
142	142	(ii) the amount of square footage formerly
143	143	used at the building or facility; and
144	144	(iii) the amount of square footage used at
145	145	the newly occupied location;
146	146	(9) a description of the continuity of government
147	147	operation plans to conduct business in alternate sites in the event
148	148	of a disaster or other emergency; and
149	149	(10) the average monthly utility expenses for the
150	150	building or facility during the previous 12 months.
151	151	(f) On request by the Legislative Budget Board, the Texas
152	152	Facilities Commission shall provide clarifying information under
153	153	Subsections (d) and (e) of this section, including information on
154	154	buildings that house multiple state agencies and other related
155	155	matters. The Texas Facilities Commission shall provide the
156	156	information to the Legislative Budget Board by the date prescribed
157	157	by the board.
158	158	(g) On request by the Texas Facilities Commission or the
159	159	State Office of Risk Management, a state agency shall provide the
160	160	agency's telework policies to the entity requesting the
161	161	information. The Texas Facilities Commission and the State Office
162	162	of Risk Management shall coordinate to reduce duplication of
163	163	efforts.
164	164	(h) Not later than June 1, 2024, the Legislative Budget
165	165	Board or a state agency designated by the board shall consolidate
166	166	the information collected under Subsections (d), (e), and (f) of
167	167	this section and enter the information into a single database
168	168	accessible by a member of the legislature or the member's designee
169	169	or the executive head of a state agency or institution of higher
170	170	education or the executive head's designee.
171	171	(i) The Legislative Budget Board shall conduct the study
172	172	required by Subsection (b) of this section and report the board's
173	173	findings and recommendations to the legislature not later than
174	174	September 1, 2024. The report must include a statewide strategy
175	175	that will ensure all property owned, leased, or otherwise occupied
176	176	by the state is adequately utilized.
177	177	(j) The Legislative Budget Board, State Office of Risk
178	178	Management, and Texas Facilities Commission shall produce maps
179	179	identifying the locations of the buildings and facilities owned,
180	180	leased, or otherwise occupied by state agencies and institutions of
181	181	higher education across this state.
182	182	(k) The information collected and produced under this
183	183	section is excepted from disclosure under Sections 552.021 and
184	184	552.156, Government Code, and Sections 412.0128 and 412.054, Labor
185	185	Code.
186	186	(l) The Legislative Budget Board may consolidate the study
187	187	and report required by this section with any report required of the
188	188	board by law regarding the allocation and use of space by state
189	189	agencies.
190	190	(m) Based on the report required by this section, each
191	191	state agency shall identify opportunities for the consolidation of
192	192	personnel and resources into space owned by this state, or if
193	193	state-owned space is not available, into space leased by this
194	194	state.
195	195	(n) This section expires September 1, 2025.
196	196	SECTION 3. Based on information collected and published by
197	197	the Legislative Budget Board as described by this Act or any
198	198	findings or recommendations by an entity conducting a study under
199	199	this Act, each state agency shall identify opportunities for the
200	200	consolidation of personnel and resources into space owned by this
201	201	state, or if state-owned space is not available, into space leased
202	202	by this state.
203	203	SECTION 4. This Act takes effect immediately if it receives
204	204	a vote of two-thirds of all the members elected to each house, as
205	205	provided by Section 39, Article III, Texas Constitution. If this
206	206	Act does not receive the vote necessary for immediate effect, this
207	207	Act takes effect September 1, 2023.
