9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 2157.068(a), Government Code, is amended |
---|
11 | 11 | | to read as follows: |
---|
12 | 12 | | (a) In this section: |
---|
13 | 13 | | (1) "Commodity[, "commodity] items" means commercial |
---|
14 | 14 | | software, hardware, or technology services, other than |
---|
15 | 15 | | telecommunications services, that are generally available to |
---|
16 | 16 | | businesses or the public and for which the department determines |
---|
17 | 17 | | that a reasonable demand exists from a customer [two or more |
---|
18 | 18 | | customers], including a state agency or [agencies and] political |
---|
19 | 19 | | subdivision [subdivisions] of this state, an entity [entities] |
---|
20 | 20 | | described by Subsection (j), or a [and] governmental entity |
---|
21 | 21 | | [entities] of another state, that purchases [purchase] the items |
---|
22 | 22 | | through the department. The term includes seat management, through |
---|
23 | 23 | | which a customer transfers its personal computer equipment and |
---|
24 | 24 | | service responsibilities to a private vendor to manage the personal |
---|
25 | 25 | | computing needs for each desktop of the customer, including all |
---|
26 | 26 | | necessary hardware, software, and support services. |
---|
27 | 27 | | (2) "Technology services" means services, regardless |
---|
28 | 28 | | of how the fees for those services are generally charged, that: |
---|
29 | 29 | | (A) relate to the development, configuration, |
---|
30 | 30 | | review, assessment, acquisition, implementation, or maintenance of |
---|
31 | 31 | | information technology hardware, software, or services; or |
---|
32 | 32 | | (B) consist of other routine technology services |
---|
33 | 33 | | not described by Paragraph (A). |
---|
34 | 34 | | SECTION 2. This Act takes effect September 1, 2023. |
