66 AN ACT
77 relating to purchasing by the Department of Information Resources
88 of information technology commodity items.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2157.068(a), Government Code, is amended
1111 to read as follows:
1212 (a) In this section:
1313 (1) "Commodity[, "commodity] items" means commercial
1414 software, hardware, or technology services, other than
1515 telecommunications services, that are generally available to
1616 businesses or the public and for which the department determines
1717 that a reasonable demand exists from a customer [two or more
1818 customers], including a state agency or [agencies and] political
1919 subdivision [subdivisions] of this state, an entity [entities]
2020 described by Subsection (j), or a [and] governmental entity
2121 [entities] of another state, that purchases [purchase] the items
2222 through the department. The term includes seat management, through
2323 which a customer transfers its personal computer equipment and
2424 service responsibilities to a private vendor to manage the personal
2525 computing needs for each desktop of the customer, including all
2626 necessary hardware, software, and support services.
2727 (2) "Technology services" means services, regardless
2828 of how the fees for those services are generally charged, that:
2929 (A) relate to the development, configuration,
3030 review, assessment, acquisition, implementation, or maintenance of
3131 information technology hardware, software, or services; or
3232 (B) consist of other routine technology services
3333 not described by Paragraph (A).
3434 SECTION 2. This Act takes effect September 1, 2023.
