| 7 | 7 | | relating to the provision of on-campus mental health services by a |

| 8 | 8 | | school district and reimbursement under Medicaid for certain |
|---|
| 9 | 9 | | services provided to eligible students. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 38, Education Code, is |
|---|
| 12 | 12 | | amended by adding Sections 38.037 and 38.038 to read as follows: |
|---|
| 13 | 13 | | Sec. 38.037. ON-CAMPUS MENTAL HEALTH SERVICES. (a) A |
|---|
| 14 | 14 | | school district may contract with a local mental health authority |
|---|
| 15 | 15 | | to provide mental health services on a campus of the district. |
|---|
| 16 | 16 | | (b) At the request of a student's parent or guardian, a |
|---|
| 17 | 17 | | local mental health authority providing on-campus mental health |
|---|
| 18 | 18 | | services that conducts a mental health or behavioral health |
|---|
| 19 | 19 | | assessment of the student or provides mental health or behavioral |
|---|
| 20 | 20 | | health services to the student shall provide to the student's |
|---|
| 21 | 21 | | primary care physician the results of the assessment conducted and, |
|---|
| 22 | 22 | | if applicable, the results of any services provided. |
|---|
| 23 | 23 | | Sec. 38.038. REIMBURSEMENT UNDER MEDICAID. The Health and |
|---|
| 24 | 24 | | Human Services Commission shall allow a school district to enroll |
|---|
| 25 | 25 | | as a provider under the medical assistance program under Chapter |
|---|
| 26 | 26 | | 32, Human Resources Code, to provide and receive reimbursement for |
|---|
| 27 | 27 | | the provision of mental health services to district students who |
|---|
| 28 | 28 | | are medical assistance recipients. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2023. |
