55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of on-campus mental health services by a
88 school district and reimbursement under Medicaid for certain
99 services provided to eligible students.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1212 amended by adding Sections 38.037 and 38.038 to read as follows:
1313 Sec. 38.037. ON-CAMPUS MENTAL HEALTH SERVICES. (a) A
1414 school district may contract with a local mental health authority
1515 to provide mental health services on a campus of the district.
1616 (b) At the request of a student's parent or guardian, a
1717 local mental health authority providing on-campus mental health
1818 services that conducts a mental health or behavioral health
1919 assessment of the student or provides mental health or behavioral
2020 health services to the student shall provide to the student's
2121 primary care physician the results of the assessment conducted and,
2222 if applicable, the results of any services provided.
2323 Sec. 38.038. REIMBURSEMENT UNDER MEDICAID. The Health and
2424 Human Services Commission shall allow a school district to enroll
2525 as a provider under the medical assistance program under Chapter
2626 32, Human Resources Code, to provide and receive reimbursement for
2727 the provision of mental health services to district students who
2828 are medical assistance recipients.
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2023.
