7 | 7 | | relating to vocational training for and the occupational licensing |

8 | 8 | | of inmates in the Texas Department of Criminal Justice. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 501.027, Government Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | Sec. 501.027. ACCESS TO PROGRAMS BY FEMALE |
---|
13 | 13 | | INMATES. (a) The department shall develop and implement policies |
---|
14 | 14 | | that increase and promote a female inmate's access to programs |
---|
15 | 15 | | offered to inmates in the custody of the department, including |
---|
16 | 16 | | educational, [vocational,] substance use treatment, |
---|
17 | 17 | | rehabilitation, life skills training, and prerelease programs and |
---|
18 | 18 | | vocational programs providing education and training designed to |
---|
19 | 19 | | ensure successful employment following the inmate's release. The |
---|
20 | 20 | | department may not reduce or limit a male inmate's access to a |
---|
21 | 21 | | program to meet the requirements of this section. |
---|
22 | 22 | | (b) Not later than December 31 of each year, the department |
---|
23 | 23 | | shall: |
---|
24 | 24 | | (1) prepare and submit to the governor, the lieutenant |
---|
25 | 25 | | governor, the speaker of the house of representatives, each |
---|
26 | 26 | | standing committee of the legislature having primary jurisdiction |
---|
27 | 27 | | over the department, and the reentry task force described by |
---|
28 | 28 | | Section 501.098 a written report that includes: |
---|
29 | 29 | | (A) a description of any department policies that |
---|
30 | 30 | | were created, modified, or eliminated during the preceding year to |
---|
31 | 31 | | meet the requirements of this section; [and] |
---|
32 | 32 | | (B) a list of: |
---|
33 | 33 | | (i) all programs available to female |
---|
34 | 34 | | inmates in the custody of the department during the preceding year; |
---|
35 | 35 | | and |
---|
36 | 36 | | (ii) vocational programs made available to |
---|
37 | 37 | | female inmates in the custody of the department during the |
---|
38 | 38 | | preceding year; and |
---|
39 | 39 | | (C) a description of any issue identified by the |
---|
40 | 40 | | department that prevents the department from making more vocational |
---|
41 | 41 | | programs available to female inmates in the custody of the |
---|
42 | 42 | | department; and |
---|
43 | 43 | | (2) publish the report on the department's Internet |
---|
44 | 44 | | website. |
---|
45 | 45 | | SECTION 2. Section 53.021, Occupations Code, is amended by |
---|
46 | 46 | | adding Subsection (b-1) to read as follows: |
---|
47 | 47 | | (b-1) Subsection (b) does not prohibit a licensing |
---|
48 | 48 | | authority from accepting an application from an inmate imprisoned |
---|
49 | 49 | | in the Texas Department of Criminal Justice. |
---|
50 | 50 | | SECTION 3. As soon as practicable after the effective date |
---|
51 | 51 | | of this Act, the Texas Department of Criminal Justice shall develop |
---|
52 | 52 | | and implement the policies necessary to implement Section 501.027, |
---|
53 | 53 | | Government Code, as amended by this Act. |
---|
54 | 54 | | SECTION 4. This Act takes effect September 1, 2023. |
