55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study of the current and potential economic impacts of
88 recycling.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. DEFINITIONS. In this Act:
1111 (1) "Commission" means the Texas Commission on
1212 Environmental Quality.
1313 (2) "Recycling" has the meaning assigned by Section
1414 361.421, Health and Safety Code.
1515 SECTION 2. STUDY OF ECONOMIC IMPACTS OF RECYCLING. (a) The
1616 commission shall conduct a study on the current and potential
1717 economic impacts of recycling, including state and local revenue
1818 that may be considered lost because recyclable materials are not
1919 recycled. The study must:
2020 (1) assess current recycling efforts, including by:
2121 (A) quantifying the amount of materials
2222 currently being recycled;
2323 (B) assessing the cost, value, and quality of
2424 materials currently being recycled; and
2525 (C) estimating the amount of materials that could
2626 be recycled but are not currently being recycled;
2727 (2) identify methods that may be used, by the public
2828 sector, the private sector, or both, to incentivize and increase
2929 recycling, including through:
3030 (A) enactment of a container deposit law; or
3131 (B) the development of:
3232 (i) new markets for recycled materials; and
3333 (ii) new businesses that may result from
3434 recycling;
3535 (3) investigate the current and potential
3636 availability of funding for the methods identified under
3737 Subdivision (2);
3838 (4) assess the current types and number of jobs
3939 associated with recycling and potential additional opportunities
4040 for job creation that may result from increased recycling; and
4141 (5) assess infrastructure needs and development
4242 opportunities associated with recycling in rural areas.
4343 (b) To the extent practicable, the commission shall use
4444 methodologies developed for other recycling studies performed in
4545 this state in performing the study under this section.
4646 (c) The commission shall prepare a written report on the
4747 results of the study and include the report in the 2024 summary
4848 report titled "Municipal Solid Waste in Texas: A Year in Review."
4949 SECTION 3. EXPIRATION. This Act expires August 31, 2025.
5050 SECTION 4. EFFECTIVE DATE. This Act takes effect
5151 immediately if it receives a vote of two-thirds of all the members
5252 elected to each house, as provided by Section 39, Article III, Texas
5353 Constitution. If this Act does not receive the vote necessary for
5454 immediate effect, this Act takes effect September 1, 2023.
