7 | 7 | | relating to a study of the current and potential economic impacts of |
---|
8 | 8 | | recycling. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. DEFINITIONS. In this Act: |
---|
11 | 11 | | (1) "Commission" means the Texas Commission on |
---|
12 | 12 | | Environmental Quality. |
---|
13 | 13 | | (2) "Recycling" has the meaning assigned by Section |
---|
14 | 14 | | 361.421, Health and Safety Code. |
---|
15 | 15 | | SECTION 2. STUDY OF ECONOMIC IMPACTS OF RECYCLING. (a) The |
---|
16 | 16 | | commission shall conduct a study on the current and potential |
---|
17 | 17 | | economic impacts of recycling, including state and local revenue |
---|
18 | 18 | | that may be considered lost because recyclable materials are not |
---|
19 | 19 | | recycled. The study must: |
---|
20 | 20 | | (1) assess current recycling efforts, including by: |
---|
21 | 21 | | (A) quantifying the amount of materials |
---|
22 | 22 | | currently being recycled; |
---|
23 | 23 | | (B) assessing the cost, value, and quality of |
---|
24 | 24 | | materials currently being recycled; and |
---|
25 | 25 | | (C) estimating the amount of materials that could |
---|
26 | 26 | | be recycled but are not currently being recycled; |
---|
27 | 27 | | (2) identify methods that may be used, by the public |
---|
28 | 28 | | sector, the private sector, or both, to incentivize and increase |
---|
29 | 29 | | recycling, including through: |
---|
30 | 30 | | (A) enactment of a container deposit law; or |
---|
31 | 31 | | (B) the development of: |
---|
32 | 32 | | (i) new markets for recycled materials; and |
---|
33 | 33 | | (ii) new businesses that may result from |
---|
34 | 34 | | recycling; |
---|
35 | 35 | | (3) investigate the current and potential |
---|
36 | 36 | | availability of funding for the methods identified under |
---|
37 | 37 | | Subdivision (2); |
---|
38 | 38 | | (4) assess the current types and number of jobs |
---|
39 | 39 | | associated with recycling and potential additional opportunities |
---|
40 | 40 | | for job creation that may result from increased recycling; and |
---|
41 | 41 | | (5) assess infrastructure needs and development |
---|
42 | 42 | | opportunities associated with recycling in rural areas. |
---|
43 | 43 | | (b) To the extent practicable, the commission shall use |
---|
44 | 44 | | methodologies developed for other recycling studies performed in |
---|
45 | 45 | | this state in performing the study under this section. |
---|
46 | 46 | | (c) The commission shall prepare a written report on the |
---|
47 | 47 | | results of the study and include the report in the 2024 summary |
---|
48 | 48 | | report titled "Municipal Solid Waste in Texas: A Year in Review." |
---|
49 | 49 | | SECTION 3. EXPIRATION. This Act expires August 31, 2025. |
---|
50 | 50 | | SECTION 4. EFFECTIVE DATE. This Act takes effect |
---|
51 | 51 | | immediately if it receives a vote of two-thirds of all the members |
---|
52 | 52 | | elected to each house, as provided by Section 39, Article III, Texas |
---|
53 | 53 | | Constitution. If this Act does not receive the vote necessary for |
---|
54 | 54 | | immediate effect, this Act takes effect September 1, 2023. |
