44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the punishment for the offense of burglary of a vehicle
77 involving theft of a firearm; increasing a criminal penalty.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 30.04(b) and (d), Penal Code, are
1010 amended to read as follows:
1111 (b) For purposes of this section:
1212 (1) "Enter"[, "enter"] means to intrude:
1313 (A) [(1)] any part of the body; or
1414 (B) [(2)] any physical object connected with the
1515 body.
1616 (2) "Firearm" has the meaning assigned by Section
1717 46.01.
1818 (d) An offense under this section is a Class A misdemeanor,
1919 except that:
2020 (1) the offense is a Class A misdemeanor with a minimum
2121 term of confinement of six months if it is shown on the trial of the
2222 offense that the defendant has been previously convicted of an
2323 offense under this section;
2424 (2) the offense is a state jail felony if:
2525 (A) it is shown on the trial of the offense that
2626 the defendant has been previously convicted two or more times of an
2727 offense under this section; or
2828 (B) the vehicle or part of the vehicle broken
2929 into or entered is a rail car; and
3030 (3) the offense is a felony of the third degree if:
3131 (A) the vehicle broken into or entered is owned
3232 or operated by a wholesale distributor of prescription drugs[;] and
3333 [(B)] the actor breaks into or enters that
3434 vehicle with the intent to commit theft of a controlled substance;
3535 or
3636 (B) the actor committed theft of a firearm during
3737 the commission of the offense.
3838 SECTION 2. The change in law made by this Act applies only
3939 to an offense committed on or after the effective date of this Act.
4040 An offense committed before the effective date of this Act is
4141 governed by the law in effect on the date the offense was committed,
4242 and the former law is continued in effect for that purpose. For
4343 purposes of this section, an offense was committed before the
4444 effective date of this Act if any element of the offense occurred
4545 before that date.
4646 SECTION 3. This Act takes effect September 1, 2023.
