99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the disclosure of customer information by
1212 government-operated utilities.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 182.054, Utilities Code, is amended to
1515 read as follows:
1616 Sec. 182.054. EXCEPTIONS. This subchapter does not
1717 prohibit a government-operated utility from disclosing personal
1818 information in a customer's account record to:
1919 (1) an official or employee of the state, a political
2020 subdivision of the state, or the United States acting in an official
2121 capacity;
2222 (2) an employee of a utility acting in connection with
2323 the employee's duties;
2424 (3) a consumer reporting agency;
2525 (4) a contractor or subcontractor approved by and
2626 providing services to the utility, the state, a political
2727 subdivision of the state, or the United States;
2828 (5) a person for whom the customer has contractually
2929 waived confidentiality for personal information; [or]
3030 (6) another entity that provides water, wastewater,
3131 sewer, gas, garbage, electricity, or drainage service for
3232 compensation;
3333 (7) another entity as necessary to facilitate the
3434 transition of customers among retail electric providers under
3535 Section 40.053 or to comply with rules, guidelines, and procedures
3636 established by an independent organization certified under Section
3737 39.151; or
3838 (8) a retail electric provider, as defined by Section
3939 31.002(17).
4040 SECTION 2. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2023.
