55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requiring public schools to make reasonable
88 accommodations for lactating students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1111 amended by adding Section 38.041 to read as follows:
1212 Sec. 38.041. ACCOMMODATIONS FOR LACTATING STUDENTS. The
1313 board of trustees of each school district, the governing boards of
1414 the Texas School for the Blind and Visually Impaired and the Texas
1515 School for the Deaf, and the governing body of each open-enrollment
1616 charter school shall provide reasonable accommodations to a
1717 lactating student enrolled at the middle or high school level to
1818 enable the student to:
1919 (1) express breast milk;
2020 (2) breast-feed an infant child; and
2121 (3) address other needs related to breast-feeding.
2222 SECTION 2. This Act applies beginning with the 2023-2024
2323 school year.
2424 SECTION 3. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2023.
