| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 38, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 38.041 to read as follows: |
|---|
| 12 | 12 | | Sec. 38.041. ACCOMMODATIONS FOR LACTATING STUDENTS. The |
|---|
| 13 | 13 | | board of trustees of each school district, the governing boards of |
|---|
| 14 | 14 | | the Texas School for the Blind and Visually Impaired and the Texas |
|---|
| 15 | 15 | | School for the Deaf, and the governing body of each open-enrollment |
|---|
| 16 | 16 | | charter school shall provide reasonable accommodations to a |
|---|
| 17 | 17 | | lactating student enrolled at the middle or high school level to |
|---|
| 18 | 18 | | enable the student to: |
|---|
| 19 | 19 | | (1) express breast milk; |
|---|
| 20 | 20 | | (2) breast-feed an infant child; and |
|---|
| 21 | 21 | | (3) address other needs related to breast-feeding. |
|---|
| 22 | 22 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 23 | 23 | | school year. |
|---|
| 24 | 24 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2023. |
