55 relating to the regulation by the Railroad Commission of Texas of
66 brine mining.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 27.036, Water Code, as added by Chapter
99 921 (H.B. 1867), Acts of the 69th Legislature, Regular Session,
1010 1985, is amended to read as follows:
1111 Sec. 27.036. JURISDICTION OVER BRINE MINING. (a) In this
1212 section:
1313 (1) "Brine mining" means the production of brine,
1414 including naturally occurring brine and brine extracted by the
1515 solution of a subsurface salt formation, for the purpose of
1616 extracting from a subsurface formation elements, salts, or other
1717 useful substances, not including:
1818 (A) oil, gas, or any product of oil or gas as
1919 defined by Section 85.001, Natural Resources Code; or
2020 (B) fluid oil and gas waste, as defined by
2121 Section 122.001, Natural Resources Code.
2222 (2) "Class V brine injection well" means a well that
2323 injects spent, naturally occurring brine produced by a brine mining
2424 operation into the same formation from which it was withdrawn after
2525 extraction of elements, salts, or other useful substances,
2626 including halogens or halogen salts.
2727 (b) The railroad commission has jurisdiction over brine
2828 mining and may issue permits for brine production wells and
2929 injection wells used for brine mining.
3030 (c) [(b)] A person may not begin to drill an injection well
3131 to be used for brine mining unless that person has a valid permit
3232 for the well issued by the railroad commission under this chapter.
3333 (d) [(c)] The railroad commission shall adopt rules that
3434 are necessary to administer and regulate brine mining.
3535 (e) [(d)] For purposes of regulation by the railroad
3636 commission, an injection well for brine mining of brine extracted
3737 by the solution of a subsurface salt formation is designated as a
3838 Class III well under the underground injection control program
3939 administered by the railroad commission.
4040 (f) For purposes of regulation by the railroad commission, a
4141 Class V brine injection well is designated as a Class V well under
4242 the underground injection control program administered by the
4343 railroad commission.
4444 (g) If rules or regulations adopted to govern Class V brine
4545 injection wells under the federal Safe Drinking Water Act (42
4646 U.S.C. Section 300f et seq.) or another federal statute allow this
4747 state to seek primary enforcement authority under the underground
4848 injection control program, the railroad commission shall seek
4949 primacy to administer and enforce the program for Class V brine
5050 injection wells in this state.
5151 (h) On delegation to the railroad commission of primary
5252 enforcement authority in this state over Class V brine injection
5353 wells, a person may not begin to drill a Class V brine injection
5454 well unless that person has a valid permit for the well issued by
5555 the railroad commission under this chapter.
5656 [(e) This section takes effect September 1, 1985.
5757 [(f) This section does not invalidate any permit for an
5858 injection well used for brine mining that was issued by the Texas
5959 Water Commission before the effective date of this section. Within
6060 90 days after the effective date of this section, the Railroad
6161 Commission of Texas shall issue a substitute permit under the name
6262 and authority of the railroad commission to each person who on the
6363 effective date of this section holds a valid permit issued by the
6464 Texas Water Commission for an injection well used for brine mining.
6565 [(g) Application for injection well permits covering brine
6666 mining submitted to the Texas Water Commission before the effective
6767 date of this section for which permits have not been issued by the
6868 commission shall be transmitted to the railroad commission.]
6969 SECTION 2. Section 27.036, Water Code, as added by Chapter
7070 795 (S.B. 249), Acts of the 69th Legislature, Regular Session,
7171 1985, is repealed.
7272 SECTION 3. This Act takes effect immediately if it receives
7373 a vote of two-thirds of all the members elected to each house, as
7474 provided by Section 39, Article III, Texas Constitution. If this
7575 Act does not receive the vote necessary for immediate effect, this
7676 Act takes effect September 1, 2023.
