6 | 6 | | valorem tax purposes as qualified open-space land following the |

7 | 7 | | death of the owner of the land. |
---|
8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 23.541, Tax Code, is amended by adding |
---|
10 | 10 | | Subsection (a-1) and amending Subsection (b) to read as follows: |
---|
11 | 11 | | (a-1) Notwithstanding Subsection (a), the chief appraiser |
---|
12 | 12 | | shall accept and approve or deny an application for appraisal under |
---|
13 | 13 | | this subchapter after the deadline for filing the application has |
---|
14 | 14 | | passed if: |
---|
15 | 15 | | (1) the land that is the subject of the application was |
---|
16 | 16 | | appraised under this subchapter in the preceding tax year; |
---|
17 | 17 | | (2) the ownership of the land changed as a result of |
---|
18 | 18 | | the death of an owner of the land during the preceding tax year; and |
---|
19 | 19 | | (3) the application is filed not later than the |
---|
20 | 20 | | delinquency date for the taxes on the land for the year for which |
---|
21 | 21 | | the application is filed by: |
---|
22 | 22 | | (A) the surviving spouse or a surviving child of |
---|
23 | 23 | | the decedent; |
---|
24 | 24 | | (B) the executor or administrator of the estate |
---|
25 | 25 | | of the decedent; or |
---|
26 | 26 | | (C) a fiduciary acting on behalf of the surviving |
---|
27 | 27 | | spouse or a surviving child of the decedent. |
---|
28 | 28 | | (b) If appraisal under this subchapter is approved when the |
---|
29 | 29 | | application is filed late, the owner is liable for a penalty of 10 |
---|
30 | 30 | | percent of the difference between the amount of tax imposed on the |
---|
31 | 31 | | property and the amount that would be imposed if the property were |
---|
32 | 32 | | taxed at market value. The penalty prescribed by this subsection |
---|
33 | 33 | | does not apply to a late application filed under Subsection (a-1). |
---|
34 | 34 | | SECTION 2. The change in law made by this Act applies |
---|
35 | 35 | | beginning with the 2023 tax year. |
---|
36 | 36 | | SECTION 3. This Act takes effect immediately if it receives |
---|
37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
---|
38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
---|
40 | 40 | | Act takes effect September 1, 2023. |
