55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an on-site physician and disclosure of physician
88 information at a freestanding emergency medical care facility.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 254.001, Health and Safety Code, is
1111 amended by adding Subdivision (5-a) to read as follows:
1212 (5-a) "Physician" means a person licensed to practice
1313 medicine in this state.
1414 SECTION 2. Subchapter D, Chapter 254, Health and Safety
1515 Code, is amended by adding Sections 254.1535 and 254.1565 to read as
1616 follows:
1717 Sec. 254.1535. ON-SITE PHYSICIAN REQUIRED; PATIENT RIGHT TO
1818 REQUEST PHYSICIAN. (a) A facility shall have at least one physician
1919 present at the facility at all times while the facility is open to
2020 provide health care services to patients.
2121 (b) A patient has the right to request that a physician
2222 perform all the patient's health care services and to receive
2323 health care services from a physician within a reasonable time of
2424 the request.
2525 Sec. 254.1565. DISCLOSURE OF ON-SITE PHYSICIAN. (a) A
2626 facility shall display a poster or other written document that in a
2727 clear and conspicuous manner discloses:
2828 (1) the name of the physician supervising any health
2929 care practitioners who are not physicians and who provide health
3030 care services at the facility;
3131 (2) the supervising physician's license number; and
3232 (3) any board certification held by the supervising
3333 physician.
3434 (b) A poster or other written document displayed under
3535 Subsection (a) must include the statement that any patient may
3636 request to see a physician and receive care from a physician within
3737 a reasonable time.
3838 SECTION 3. This Act takes effect September 1, 2023.
