6	6	AN ACT
7	7	relating to an on-site physician and disclosure of physician
8	8	information at a freestanding emergency medical care facility.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 254.001, Health and Safety Code, is
11	11	amended by adding Subdivision (5-a) to read as follows:
12	12	(5-a) "Physician" means a person licensed to practice
13	13	medicine in this state.
14	14	SECTION 2. Subchapter D, Chapter 254, Health and Safety
15	15	Code, is amended by adding Sections 254.1535 and 254.1565 to read as
16	16	follows:
17	17	Sec. 254.1535. ON-SITE PHYSICIAN REQUIRED; PATIENT RIGHT TO
18	18	REQUEST PHYSICIAN. (a) A facility shall have at least one physician
19	19	present at the facility at all times while the facility is open to
20	20	provide health care services to patients.
21	21	(b) A patient has the right to request that a physician
22	22	perform all the patient's health care services and to receive
23	23	health care services from a physician within a reasonable time of
24	24	the request.
25	25	Sec. 254.1565. DISCLOSURE OF ON-SITE PHYSICIAN. (a) A
26	26	facility shall display a poster or other written document that in a
27	27	clear and conspicuous manner discloses:
28	28	(1) the name of the physician supervising any health
29	29	care practitioners who are not physicians and who provide health
30	30	care services at the facility;
31	31	(2) the supervising physician's license number; and
32	32	(3) any board certification held by the supervising
33	33	physician.
34	34	(b) A poster or other written document displayed under
35	35	Subsection (a) must include the statement that any patient may
36	36	request to see a physician and receive care from a physician within
37	37	a reasonable time.
38	38	SECTION 3. This Act takes effect September 1, 2023.
